Should 13 y.o. boys be allowed to consent to hetero-sex w/adult women?

Should the age of consent be lowered to 13 y.o. when a boy wants sex with a woman?

With consensual sex, who is the perp? It is assumed to be the eldest person, but that isn't always the case, is it? Seems there have been situations where teen boys have been charged with forcible rape of adult women, so is is possible/probable that teen boys can also get consent from an adult woman if the law allowed?

I'm just pointing out that there's risks to sex no matter what context it's in with the married couple example hi-lighting such risk. I'm not sure where the passive-aggressive assumption comes from that I think everyone cheats.


There are big risks and smaller risks, manageable risks and unmanageable risks. I would know: I'm a risk-taker. :mrgreen:

However, the difference in STD risks between a sexually active 13yo and an adult married couple are so huge that the comparison is a bit ridiculous.
 
And if someone cannot truly comprehend or account for all of the consequences of their actions, are they really consenting to it? Consent isn't really consent. Informed consent is. You are arguing that consent can come from a place of ignorance. There is no magical yardstick to know what someone is thinking to know if they truly consent to something. Minors, far more often than not, do know have the knowledge or understanding to make these decisions. Just like drunk people.



Well, too bad. We're not talking about making different laws drastically curtailing behavior for one sex. We're talking about protecting children. You specifically chose to form the OP as you to play on the social stigmas, that he is victorious for conquering her, while if their sexes were swapped, she would exploited. That is the exact opposite of what I meant by "harsher". There is just as much room for abuse by an adult regardless of the gender pairings involved. But girls face harsher physical consequences. They should NOT face harsher social ones. All children need to be protected from sexual exploitation by adults.

Laws are based on social stigmas. If you want to talk about flipping things then women who have sex with boys should be thrown in jail for life just like men. I'd rather not see that tbh. Is it hypocritical? Well yeah but we as a society are hypocrites. If we're going to be all wink-wink, nudge-nudge when boys have sex with women then we should at least make it easier to do so.

How many 13 year olds doesn't grasp the responsibility of getting someone pregnant?

Hell... there are already too many adults who do not. Why should we make such numbers worse?

Nobody should be having sex anyway, unless they can financially and mentally shoulder the burden of a unplanned pregnancy.

I mean quite clearly that teen boys have committed and been charged with rape against adult women wherein it is clear the teen raped, forcibly, an adult. Were that same teen to have consensual sex with a different adult woman, she'd have been the one charged with rape. Somehow that doesn't make sense to me.

I'm old fashioned - I remember a time when we were happy to let children have childhoods and not pushed to ever lower the age of adulthood. Then again, if in Obama's America it's okay for 13 year old girls to buy morning after pills OTC, you'd better be okay with 13 year old boys having sex with them, because the alternative isn't too appealing.

You mean physical force? So you're confused about the difference between someone freely engaging into an activity and force being used to influence them against their will?

Right, because in one instance she was forced into the encounter through physical force, in the other there was no physical force used. And the decision, to enter into such a relationship, was engaged in freely by her. The reason she is considered at fault in such situations is because she is an adult and assumed to be able to recognize the legal and moral issues with it, while a child is not. That is why she is granted rights and responsibilities we do not grant children

Like I said it makes no rational sense. If a teen can choose to rape and be held responsible, then why is it that a teen choosing to have consensual sex is HER fault? Makes no rational sense at all.

1) we have a juvenile justice system because we recognize the same level of agency isn't acted upon by adults and children.

2) what don't you get about the difference between someone acting freely, as opposed to acting under the threat of physical force?

As I said and will continue to say, focusing on the teen, it makes no sense that he is responsible for one action but too young to be responsible for the other. Granted, laws say there is a difference, and that's what I think is irrational and stupid.
 
13 year old boys, are you kidding me?
No 13 year old is ready for sex, whether it is a girl or a boy. Sex with another teen is just teenage stupidity, and to be discouraged whenever possible. Sex with an adult is coercion on the part of the adult and is just one tiny step above raping nine year olds.

Of course not. Should they be able to make their own decisions as to whether to go to school, pick up their room, treat adults with respect, or any of hundreds of things adolescents think they should be able to decide for themselves?

Of course not. They're still kids, and under the authoritarian regime of their parents (or should be).
 
Because no parents want THEIR kids to have a juvenile rap sheet for having sex [with a like aged partner] prior to the law saying they are able to - and like it or not parents are all too aware that it could easily be their kid if such a law was in place.

This is a matter that should be addressed on the family level, and not criminally.
When it comes to older people taking advantage.. then we have criminal issues.

I didn't want there to be any misunderstanding about homosexual sex, or 13 year old girl having sex with and adult.

I needed to be as clear as possible because this is an internet forum. I already had to deal with one poster insinuating something untrue despite how clear I was.

Isn't the question more accurately can they consent? I believe they can, so of course, I think it should be allowed that they are permitted.

I highly doubt that the majority of the cases you see are indeed rape or forced on the boy in any sort of way what so ever.

Adult women having sex with under-age boys never has been and never will be OK. It's against the law in the USA.

An under-age boy can't legally consent to sex with an adult woman. That defense won't stand up in court.
