The system is in need of reform and improvement, is this not the purpose of all our law-makers ? That state's governor should hang his face in shame.
Hopefully, this rapist is confined, obviously this should be permanent....a life on a prison farm....grow your own food, make your own clothing....otherwise starve and go naked....
The hopeless should not be coddled.

You don't see the irony in wanting the rapist confined yet being perfectly OK with his victim not testifying against him? Have I entered Wonderland?
 
My immediate thought is 'just what the hell else is going on that we dont' know about from this short little article?'

I really don't want to present a view - and take time to consider things - without knowing more about what's really going on. They dont' just take victims and toss them in the clink - there's obviously much more to it than that.

I read several articles from different sites on the case last night. Apparently, this girl has a history of being a runnaway, so they are trying to force her to testify (via detention), because they want the guy convicted. A couple of questions that enter my mind are 1) If she has an unstable mental and social history, how convincing is her testimony? 2) If the guy's a "serial rapist" as was mentioned in one of the articles, why are there no other credible witnesses to call? The whole thing reeks of coercion of an innocent person in order to make a conviction, regardless of how unjustifible it may be.
 
If she does indeed have a few runaways on her juvenile record... and record with by law cannot be made public... then someone in the D.A.'s office or the sheriff's department illegally leaked that information in order to support their indefensible treatment of this child. The entire thing is outrageous.

Her name has not been released, so they can talk about her record. Since she is a minor her name in connection with the incident will never be released.
 
She's a mentally unstable rape victim, and you want to put her in prison?

No part of being a rape victim gives anyone the right to ignore a summons.

Guess what: she still has to obey traffic laws, to.

He's a serial rapist: aren't there other victims? How can a serial rapist be convicted based on her testimony alone? - Someone already brought these thigns up and I think they're good point. They don't seem to have a very solid case against him if the only person is a flighty underaged runaway who - though being underaged - doesn't have a compelling foster care family to stay with.

maybe they need to find her a gaurdian and a home instead.

Maybe all of his other victims declined to testify also. In which case he goes on raping.

So - that leads to the next logical question: why aren't they all imprisoned together?
 
Even if she failed to appear after a subpoena, which they can arrest her for, they CANNOT force her to testify.

However, my suspicion... and this is only a suspicion, not actual knowledge... they are doing whatever they can, staying just this side of the edge of the law, to intimidate her into thinking she has no choice but to testify. Most people do not know their rights, and I'd bet she does not, and the prosecutors are attempting to take advantage of her lack of knowledge.

She has a home and a guardian... her mother, with whom she has not been allowed to speak since her incarceration in March. It's a travesty.

Some people are literally willing to go to ANY LENGTHS, including advocating for the dumbest possible application of the law, in order to **** over a 17-year-old girl who has been victimized by rape...not because anything good can come from it (i.e. coerced testimony isn't credible anyway), but just for the hell of it. It shows that the Taliban mindset is alive and well here in the United States of America. :(

Speaking of laws: There should be a law that only those of us who've actually been shot at by the Taliban, have the 1st Amendment right to compare anyone else to the Taliban.
