Scary run-in with the police today.

tldr: Skeptic Bob gets pulled over by cops. They take his weed and let him go. Skeptic Bob still whines like a bitch despite his good luck.
Skeptic Bob points out why this issue needs to be addressed at the Federal Level and make pot legal Nation Wide. States can make their own rules when it comes to specific issues but use and possession should not be something they should have the right to ban. Treat it like alcohol and leave it at that.
You got lucky Bob, you would not have gone to prison, but it could have cost you thousands in fines and attorney fees, not to mention the inconvenience of being arrested and going to court. So, yes you should be thankful that the officers simply let ya go on your way, they could have been far more harsh.

Wow! I didn't realize dogs can smell sealed vape fluid. That sucks.

Right?! And it was in my trunk wrapped in a plastic bag, still in its original wrapping. And I hadn’t vaped in the trip at all so it likely wasn’t that. The more I think about the less likely I think that is the case. I think it was one of two things.

1. What the dog actually smelled was the residual odor on my clothes from the smells I picked up inside the dispensary that day. I remember when I arrrived at the dispensary I could smell the weed from the parking lot before I even got out of my car. I am guessing I picked up enough odor particles during my 10 minutes in there for the dog to hit on.
2. The dog didn’t actually hit on anything. The cop just picked up on my body language and my increased anxiety when I saw the dog and interpreted the dog how they wanted to. I feel like the K9 Officer and the Officer sitting with me were exchanging some signals with each other but that could be my imagination. Maybe the dogs really are just that good.
 
I've never tried to drive from CO back to AZ with stuff. I am going to drive to NV soon, not sure if I want to risk anything. I have flown with some edibles, gummies that were mixed into a big bag of assorted nuts and dried fruit in my carry-on. I need to buck up and get my medical card, I have 3 brothers with cards, and it helps them greatly, they all have neck/knee injuries from doing Judo as kids and wrestling in HS (I was the only kid not to do Judo/wrestling in my family...something I am very happy now about). Other brother has kidney stones every month for last 40 years, he has destroyed his two kidneys and has one transplanted from another brother. Medical marijuana works for so many things, pain, panic attacks, etc.

Yep. My wife gets horrible migraines on occasion. When I was in the military (before using and having weed) if it got too bad for her Meds to work she would have to go to the ER and be pumped with a cocktail that would stop the migraine flat. But then she was in the ER for several hours. With weed, on the other hand, about half the time she could manage it without an ER trip.

My wife’s Meds are not opioids and it isn’t a daily struggle for her, but I can only imagine the frustration of people with chronic pain who feel they have to chose between legal, but harmful, opioids and illegal, but far more benign, marijuana.
 
I feel your pain. Really...I do. As a two-tour vet of the Vietnam War, I have more than an inkling of what you are going through.

But GOD DAMMIT!!! Why the ****!! did you do this stupid ****!!??

1. Okay, you drove from VA to Boulder ****ing Colorado for meetings...for your work. Yeah, I "suppose" that could be reasonable...but it raises flags.

2. You have a CCW permit. That's good. You brought your gun along. Okay. But you kept it in a locked box. Why did you bring it? For emergencies? In a locked box? Useless. For Boulder CO? Seriously? A freaking liberal college town? It's not like you were hanging out on E. Colfax, for god's sake.

3. And then, knowing you were transporting illegal drugs cross-country, you do stupid **** like camping in a passing lane and changing lanes without a turn signal...AFTER you see the cop car.

My 20/20 hindsight today is in full agreement with everything you said. I think I have gotten complacent about such things. I spent most of the recent couple decades with diplomatic immunity, untouchable by law enforcement where I was stationed. Not that I would risk my security clearance back then on something like weed. And then the last time I have been stopped in the US for anything was back before I enlisted in the Army and was delivering pizzas. Illegal U-turn. I had never been searched by police in my life.

Complacency-fuels stupidity. Guilty as charged. Lesson learned.
 
I was just thinking that he should have driven through Kansas instead of OK. I'm not sure why he veered so far South. I would have hopped on I-70 and stayed on it until St Louis, then hopped on 64 into VA. There is no reason to take I-40 at all.

Yep. If not for my Memphis stop today Imwouldmhave gone through Kansas. That is the way I went on my first leg of the trip. Almost no cops at all. Oklahoma I felt like they were spaced out every other mile.
 
There was a OK poster who chimed in and claimed that portion of highway is given better notice than others. I get the K-9 thing in airports and public places, but since you exercised your right and declined to give permission for a search, couldn't an argument be made that using the dog to 'search' is a violation since you declined? Not looking to derail, just thought came up.........

They don’t need your permission to have the dog smell the outside of your car. And then if the dog hits, they don’t need your permission to search the inside of your car. Without a dog hit or your permission they can’t search the inside of your car without other probable cause.
 
Totally different terrain, more cars on 70, and the likelihood of being pulled over for hogging the Left Lane much lower. OK is just miles and miles of flat nothing. So, a cop can easily shadow you from a mile back and watch your every move.

Pretty much what happened except the cop car was parked up ahead of me on the median. But no other cars around so he probably saw me cruising in the left lane for nearly a mile.

I certainly sympathize with your condition. I have some PTSD from past events and often have trouble sleeping as a result, as well. Probably not as bad as what you're dealing with, but enough to sympathize certainly.

I couldn't use weed.... have to stay clean for work.

As for what happened to you with the Okie cops... well, you were lucky. If you weren't a vet, you might have been busted for intent. If the cop wasn't a vet, maybe same. If you'd done or said anything different who knows.

We have a very peculiar situation in the US where you can legally buy or have X in this state, but not in that state, and maybe not by Fed law, and maybe get busted for legally buying X in one state and passing through another. I'm thinking of more than just weed.

On the one hand I think some might resent that you got off mainly because you're a vet, where someone not a vet but with equal need might have been in BIG trouble.

On the other hand even when I was in LE, lots of cops were no longer busting people for simple weed possession unless there was some other reason they wanted to arrest them (like suspicion of other things, or general assholery). This in a conservative state where weed is not legal for any purpose.

I support full and complete legalization of weed, from production to sales to end user, as I don't feel the prohibition is overall of benefit to society. I don't use the stuff myself and don't wish to, but anyway.

At least I would hope they have that same compassion for other people with similar amounts. He was treating me very respectfully even before he knew I was a veteran. Of course I was doing the same to him, too.

It is very commonly true, that the attitude you get from most cops depends on the attitude you give them. Lotta people don't seem to understand that.

There are exceptions, of course, but by and large...

I wouldn’t call a marijuana vape natural. Not to mention that even the plant marijuana isn’t really natural nor does natural mean good.

Yeah, I don’t personally rely on the naturalistic argument. Arsenic is also natural. I just know that THC doesn’t screw me up the way my past prescription drugs do. I prefer vaping because while marijuana smoke isn’t as harmful as tobacco smoke, it is still smoke and I would prefer not to fill my lungs up with it. There is also no prep with vaping. Just take a puff when you need it and then put it away. No lingering odor...to the human nose, that is. :)

Hard candy edibles are easy to dose as well but I dislike them for one of the reasons I dislike pills of any kind. They can last too long in your system, they can take too long to kick in which is problematic if you are using it for non-recreational reasons, and it is tough to adjust the dose to your need. With vaping it kicks in immediately and I can just stop there or vape a little more as needed. If I accidentally vape a bit more than I need it will wear off very soon anyway. I’m not stuck with an unpleasantly stronger does than I need for hours.

My friend I am so sorry to hear this story. I am extremely glad the police used discretion in your case, but this just illustrates how obvious it is that the war on drugs is used as a method of rounding up undesirables.

This is why we so desperately need a national legalization push. To protect people like you from a police officer who isn't so discerning.

Thank you for your service. I'm sorry the nation put you through this. My heart goes out to you for your struggle. Stay strong brother.

Well to be fair, we have a state wide petition to change that...

But our laws aren't very draconian, and as the OP's story shows you outsiders our LEOs don't jackboot out of state drivers with a rather impressive amount of vape pot. Could have been a righteous bust of an out of state drug runner so there is that... :peace

No, it wasn't tldr - I read it all. I didn't serve - 4-F (is that still a thing?) and way more serious than heel spurs. Anyway, I sympathize with a service-connected physical disability but I figured PTSD was just whiney bitches that needed to shut up and suck it up. But I know you to be an honest poster - dunno if you changed my mind, but you sure made me made me think. Anyway, sorry they confiscated your weed but glad there weren't more serious consequences.

Yeah, and I’m nor really inclined to pick on states about this. Some states probably just don’t want to go against the federal government. If the federal government decriminalized it and some states still criminalize, then I will become judgemental.

To be honest, I used to feel the same way about PTSD. I figured it was just people giving into fear or not just sucking it up. And I had seen and done some rough things before that didn’t have the same effect on me so couldn’t other people just deal the way I did.

But the human brain is a complicated thing. Get it firing the wrong way and it takes more than mere will power to get it going right. It is an organ, just like the heart or appendix. We don’t tell people with heart attacks or an appendicitis to suck it up.

It took it happening to me to really understand that.

None of my friends or family know about me dealing with this. I don’t want to appear weak. I don’t want them to worry about me. In fact, the only people I have mentioned this to who aren’t paid to listen to me are all of you here at DP. There is a comfort in the pseudo-anonymity.

They CAN'T, the trooper lied about the hit.
But that is what they do, they SAY that "the dog hit" on the trunk and then it boils down to "my lawyer is bigger than your lawyer" and in any case in Oklahoma you get tried for $1,000 worth of weed because the court will side with the officer.
And they know it.

This sucks ass in the worst way possible. Come to California.

Seriously ithough, Bob, you were lucky. You’d have been arrested in Texas. Not just for marijuana either but for THC, which is in penalty group 2, meaning any possession is a felony and the punishment ranges are almost exactly the same as with cocaine and heroin.
