Freaking Social Security BS.

Without more info, your post does not make sense.

I never heard of this with Social Security, unless it was fraud.

If his parents were in a nursing home that Medicaid paid for, them CMS is going to clawback the money from their estate. Talk to an atty that specializes in Medicaid

I have heard of this type of thing before. If I remember correctly it involved Medicaid and having to put people in homes that could provide 24 hour care. I wish I remembered the exact details.

Yes, with Medicaid. But not SS.

Can you expound on that? It's not meant to be able to support you if it is sole income at/after retirement age. Not real clear, aren't there circumstances when SS pays before retirement? Catastrophic accident or disability? Surviving spouse etc. I am not for the govt being involved in these kind of things, but what are the alternatives?

A nice older couple that I used to do work for sold a well kept older ranch house for under the market value and was penalized by the government/medicaid when it came time for assisted living. They were in the process of moving into a apartment at one of the areas well known assisted living facilities when Gov't conducted a 5 year look back and tried to blind sided them.

The real estate broker that I used to work for actually helped pay for the apartment until the government and lawyers stopped slicing and dicing their savings. (one of the kindest things I have witnessed)

Hmm. That makes a little more sense. My brother has received SS his whole adult life due to his cerebral palsy. He does work full-time but there is a limit on how much he can have to his name at any time in order to keep getting those benefits. I know, for example, he can't own a home. Not exactly the same situation but I understand how complicated it can get. Have them talk to an attorney. Sometimes there are ways around these kinds of things using trusts.

I think that it has to be in 'trust' for 5 years. ..

Are you sure you are not confusing SS with a deal your parents have with a retirement home? I know that when one cannot afford a lifetime of retirement in a full care facility, the home often requires you to hand over all assets, Medicare then pays the rest.
 
If people can pay for their end of life living situation then they and not the taxpayers should pay for their end of life living situation.

Which the point of situations like this, they dont get to collect $40K+ a year from the government for a place to live and then pass along a large sum to their estate too.


Pretty clearly the mistake here was on the part of the homeowners.....had they done things right the home would have been sold to family and then the money used for living BEFORE government funds were tapped, or maybe the Trust Concept works too....the point is the the government is not at fault here.

With all due respect, I'd need a little more info before getting irate on your family's behalf. ;)

AFAIK Social Security never claws backs assets, even if you're on disability. With SS, you're just collecting funds based (more or less) on what you paid into it.

In contrast, Medicare and Medicaid can do that, under certain circumstances. Basically, if you transfer all your assets to someone else, and then try to go on Medicare or Medicaid, the government has a 5-year "look back" period. Basically they want to make sure you aren't gaming the system, and making yourself look like you're broke, when you have the funds.

Either way, sounds like it's time to talk to a lawyer.
