Trump administration revokes tribe’s reservation status in ‘power grab’ | US news | The Guardian

Sign of willingness to use discretionary powers to attempt to take lands away from Native American tribes, advocacy group says

A tribe is losing reservation status for its more than 300 acres in Massachusetts, raising fears among Native American groups that other tribes could face the same fate under the Trump administration.

The Mashpee Wampanoag tribe, which traces its ancestry to the Native Americans that shared a fall harvest meal with the Pilgrims in 1621, was notified late on Friday by the federal Bureau of Indian Affairs that it will be rescinding its reservation designation and removing the land from federal trust, according to Cedric Cromwell, the tribe’s chairman.

I don't have the background on this, but Trump fought an Indian tribe in CT that eventually led to the Foxwoods casino & one of his Atlantic City casino bankruptcies.

Hmmm, let's see:

The US Department of the Interior, which oversees Native American affairs, is obligated by a recent federal court decision to remove the special land designations, which were bestowed in 2015 under then President Barack Obama, according to Conner Swanson, an agency spokesman.

In February, the US court of appeals in Boston upheld a lower-court decision declaring the federal government had not been authorized to take land into trust for the Cape Cod-based tribe.

So perhaps we need to go to the court decision, who filed the suit, and the merits of the case. Was it filed by the Trump Administration?

I'd like more information on the suit that led to this decision.

And here it is:

The court upheld a 2016 decision by U.S. District Judge William Young that the tribe was not under federal jurisdiction at the time the Indian Reorganization Act was passed in 1934, disqualifying it for land-in-trust status. Young had sent the case back to the Interior Department, which reversed its earlier decision.

Apparently the tribe wanted to "nationalize" for their own profit, some land they had leased to develop. So in 2015 the BIA approved the TAKING of two areas of land in trust for the tribes use:

The Tribe planned to acquire the Taunton land, which was "developed as a commercial/industrial park," to build and run "an approximately 400,000 sq. ft. gaming-resort complex, water park, and 3 hotels."

So, people are thinking someone is taking tribal land away, when in fact it was the tribe "taking" land in 2015 to turn into another "resort complex."
