Delaware’s death penalty is unconstitutional, the state’s Supreme Court declared on Tuesday.As Jessica Masulli Reyes reported for the News Journal, the 148-page opinion struck down how the death penalty is applied in Delaware, declaring it a violation of the Sixth Amendment–sanctioned role of a jury. The ruling follows the US Supreme Court’s January decision against Florida’s death penalty on similar grounds.

So this doesn’t mean that Delaware’s death penalty is completely dead, since it could be revived by the state’s legislature if lawmakers alter how a death sentence is carried out.
But if Delaware’s legislature does not act, New Hampshire will become the only state in the northeastern part of the country that still allows the death penalty:

Am I correct in assuming this cannot be appealed to SCOTUS since it involves a state constitution?

I pretty sure the Supreme Court can hear cases involving a state constitutional amendment. I believe the Supreme Court dos have the power to overturn state constitutional amendments. I believe this would come from the supremacy clause.
 
if a defendant is guaranteed to have sentencing determined by a jury, i don't understand how "mandatory minimum" is constitutional. While we're at it, why not just allow juries to hang someone guilty of petty theft or to sentence a murderer to a day at county

it can't be appealed because SCOTUS already made the same ruling against florida for the same reason. This was just the delaware court affirming that the SCOTUS decision applied to their state as well

That is insane. Too many people just need killing and wasting taxpayer dollars feeding and housing them for life is too good for them.

It's no deterrent whatsoever because they adapt to prison life.

We have the DP in Oregon and the last Gov.(the crook who was forced out of office), stated that he would not allow it on his watch. So he Unilaterally usurped the decision of the people (voters) and overrode them. The interim Gov. has done the same. Assholes all!

If you want to act like the savages who participate in such heinous public executions in places like Saudia Arabia and Iran, I guess. I'll pass, I enjoy being civilised.

Designated time- Sunday after Church.

Make a picnic, grab the wife and the kids and mosey on down to the town square for an afternoon of entertainment. Good, solid family time. Shop owners can sell souvenirs and alcohol and when the deed is done you can all push and fight each other to try and grab some of the "leftovers" for a keepsake.

Civilized? Most people who deserve killing, are not civilized at all and the places you mentioned do not have anywhere close to the crime we have here. Watching that head roll with the eyes still blinking in shock, is a pretty good deterrent.
Trouble is, liberals talk about punishment, but they have no stomach for it. They prefer a sanitized view of the world, like the dopes who sanitized the Holocaust camps. Lethal injections are as dumb as it gets and Tinker Bell liberals turn my stomach!

The sick puppies are the monsters that rape little kids in every orifice available... and do it for months or years..........while married.
Sick puppies are the people that imprison women for years(plenty of evidence of that), or slash a victim repeatedly and torture them until dead or wished they were.
Sick puppies are the guys who do home invasions, rape the wife and kids and make the husband watch.

Yes and that is why I'd like to see them pass a law to restrict appeals to....ONE! And in many cases, no appeal ALLOWED!
Streamline the process, cut the red tape, knock off the bull**** and get it done! :wink3:

I escorted one of these pieces of filth to court....for the 11 week process of jury selection, trial and death penalty phase. He slashed a young woman 54 times, in a drug fueled rage, was caught the next day and arrested, tried, convicted of aggravated murder, sentenced to death and then had 42 ****ing appeals! You should have seen the photos of her body, head nearly severed, one breast cut off and she lived for over an hour after the attack. A farmer and his wife witnessed the murder and had an opportunity to shoot the scum, but choked! Slam dunk case!
That was in the late 80s, and he is still on death row and has several appeals remaining.....and the lame ass Governor won't allow any more DP convictions carried out here, overruling the vote of the people, in that matter!

That is only one example of many that I have seen first hand. Executions are sorely needed, in many cases!

Then there was the guy who had a restraining order filed against him, his wife had moved out and would testify against him. One evening, he kidnapped her and the two children, a 2 y.o and a 4 y.o. Drove them in her car, to an empty field and cut her head off leaving it in the front seat next to her body and the 2 kids were in the backseat. They sat there in the backseat of the car, all night after watching it happen. A guy walking his dog the next morning, found them and called it in.
His bloody prints were found at the scene and the 4 year old told us that "Daddy cut off Mommy's head and she won't talk to us."

Then there was the husband and wife duo, who sexually abused their two kids, plus the four others left in their custody by relatives. The wife would hold them down while hubby did them. Ages ranged from 5 years old to 17. The 17 year old finally talked to her high school counselor about the rapes that had gone on since she was 5 or 6, and the police called.

I could go on and on and on....with heinous crime after heinous crime that I was involved in as a cop. And some here have the nads to say that I'm the sick puppy. I reject that in total. I'm very pro DP with no appeals.
