Wisconsin couple says property owner ordered them to take down gay pride flag

"My flag is not doing anything," Kevin Kollman said. "It’s just a symbol of who we are, where we came from and our love for the United States."

A Wisconsin couple said they were ordered by the property owner of their apartment complex to remove their gay pride flag or face eviction.

Kevin Kollman and his partner, Merle Malterer, who rent a unit at Country Oaks Apartments in Oak Creek, Wisconsin, said they received a five-day eviction notice in the mail on Wednesday informing them that their lease would be terminated if they did not remove the gay pride American flag — which features 50 white stars and rainbow stripes — from the patio of the property.

These guys are in clear violation of the quoted clause in their lease.

"IF" this part is true:
About 10 to 12 others at Country Oaks Apartments have American and police pride flags hung from their rental units, they said.
and those people werent addressed in anyway about their flags resolving the issue or theres something left out then no they are not in clear violation at all and they are being illegally discriminated against

now . . is it possible that all the other residents asked or paid some type of fee or have an agreement that allows their flags? yes of course but its probably unlikely . . so again if that part is true then they have a case.

Unless the lease is written to explicitly allow American, and police pride flags (I didn't know there was such a thing) and the exclusion of all others, then they are totally right to fight it.

American flag no, police pride flag yes as the later is a political flag, the American flag is not.
 
If other people have flags and the apartment complex turns a blind eye to it, that puts this tenant in a tough spot. On one hand, I would want to point out the double standard. On the other hand, I wouldn't want to be the guy to rat out my neighbors and get their flags taken down. I don't rat out people who aren't hurting innocent people, even if it benefits me.

The owner is not against same-sex relationships or the LGBQ community. The whole reason the owner requires tenants to get permission first is that a given request might harm others in the form of lowered property value. The owner does not oppose gay rights. The owner has a contractual obligation to protect everyone's property value, and applying for permission is the process to let the owner evaluate if a given request would be a harm to others through property value loss. Someone desiring to fly a confederate flag has to go through the same process.

The tenants acted against the terms of their agreement and then cried 'victim' when the property owner held them to the rules they agreed to abide by.

Not all requests are equal. Just because one flag is approved does not mean all other flags will be approved. One flag might harm property value while another would not. Imagine if white supremacists demanded to be allowed to fly a Nazi flag on the basis that all flags are the same and the LGBTQ flag was allowed. This is a case-by-case basis.
