The co-owner of the waterpark where 10-year-old Caleb Schwab was decapitated in 2016 was arrested and held without bond Monday in Texas pending his return to Kansas to face charges in connection with the boy's death.

The man, Jeffrey Wayne Henry, 62, co-owner of Schlitterbahn Waterparks and Resorts, was arrested in Cameron County, Texas, on a federal warrant that was issued after the company's Kansas City, Kansas, park and its former director of operations, Tyler Austin Miles, were indicted last week in Kansas state court in the death of Caleb, the son of Kansas state Rep. Scott Schwab.

They knew that the sled featured in the water slide attraction would go airborne. The weight of the single 10-year-old passenger appears to have not been heavy enough to prevent the sled from going airborne & leaving the slide, killing the boy instantly.

When I read this story, it seemed harsh. I mean, murder? aggravated assault? REally? Seems more like negligent homicide or something along those lines. I bet it was because it was a state representative's son.

Where is the responsibility of the state to make sure the ride is safe before it is opened?

Murder ? They won't get a murder charge
Two women were on that " sled " too, and both were injured. He was not riding alone.
That slide had been in operation for some time so it wasn't his weight or lack of
Pretty sure it had to do with worn or broken straps that were used to keep riders from going airborne
 
The original Schiltterbahn is amazing. When they built that park and put that slide in, I could only think "That's insane, I wouldn't ride it" Sad it took a child to die to close it. That being said, there has to be more to the story here for such legal ramifications.
 
I thought murder was going too far. But a week or so ago I read another article about this case, workers at the park told authorities they have problems and safety issues with this ride from Day 1, but nobody seem to care. And the car this kid was in when he died had become airborn before, a few times, and the brass knew it, but again they did little to fix the problem.

They'll probably drop this down to manslaughter. But if this evidence is true they will be serving some serious time in jail.

According to the indictment, while Caleb's death "appeared at first to be an isolated and unforeseeable incident," park employees "came forward and revealed that Schlitterbahn officials had covered up similar incidents in the past" involving the water slide.
The Friday indictment says the park knew about the issues with the ride, including design failures and maintenance issues, and was aware of other injuries sustained by riders prior to Caleb's death. It details injuries suffered by at least ten other people, ranging from concussions to multiple broken toes.

The raft Caleb was using during the incident was known "for going abnormally fast and going airborne more frequently than other rafts," the indictment says. It was removed twice in 2016 but quickly put back into circulation, investigators learned, according to the indictment.
Investigators also found multiple flaws in the ride design, noting that "it was never properly or fully designed to prevent rafts from going airborne."
Verruckt's design "violated nearly all aspects of the longstanding industry safety standards," the indictment says, adding "in fact, the design and operation of the Verruckt complied with few, if any, of the industry safety standards."
