Oklahoma sheriff and all of her deputies resign in protest over dangerous jail conditions

Nowata County Sheriff Terry Sue Barnett cited high levels of carbon monoxide, exposed wires in showers, gas and mold issues.

March 20, 2019
An Oklahoma sheriff and the majority of her staff quit after citing uninhabitable conditions in the county jail. Nowata County Sheriff Terry Sue Barnett tendered her resignation on Monday after a judge mandated her to reopen the county jail after high levels of carbon monoxide sent four of her employees to the emergency room last month. The sheriff said that Nowata District Judge Carl Gibson informed her last week that if she did not bring the more than a dozen inmates back to the Nowata County Jail, she would be held in contempt of court. "I've said from the beginning that if I became sheriff, I would serve the citizens by standing up and doing the right things," Barnett, who was elected in November, said in a statement. "This is just wrong, and I wasn't going to put human beings in that jail until we knew what was going on. Twelve members of the Nowata County Sheriff's Office staff, including deputies and civilian employees, resigned with Barnett on Monday. Even the K-9 officer, Ranger, quit and signed his resignation letter with a paw print, Barnett said. The "tipping point" for the sheriff was the Feb. 28 incident in which the level of carbon monoxide in the Nowata County Jail came to 18. She said the standard lethal level is 20. Barnett immediately evacuated her staff and the inmates from the county jail, which serves more than 10,000 people in the nearly 600 square-mile region. The source of the high levels of carbon monoxide is still unknown, she said.

In the resignation letter, Barnett also detailed other dangerous conditions in the "inadequately budgeted" jail, including exposed wires in the shower areas that have shocked inmates, mold throughout the jail and offices, and "improper" plumbing that often causes methane gas to permeate the jail. The inmates were transferred to Washington County, where they remained as of Wednesday, according to the Nowata County Clerk. Judge Gibson declared Barnett's resignation "void" on Tuesday, but the sheriff said that is not within his right. "I do not work for the judge. The judge is an elected official. I am also an elected official," Barnett told reporters. "I do not believe we live in a country where we can be ordered to go to work when I have already tendered my resignation." "As most of these things go, it's all about money," Barnett's attorney, Paul DeMuro, told NBC News. "The jail is a huge source of revenue for the county, so the financial piece of this story is a very important one." Nowata is the third poorest county in Oklahoma, with a total operating budget of less than $1 million, according to KJRH. "The Nowata County Jail is a ticking time bomb of constitutional liability," DeMuro said in a statement. "If the county thinks it has budget problems now, it better wake up because somebody is going to die in that jail."

The entire county operating budget is <$1 million. That is really paltry. No wonder the county jail is decrepit and dangerous.

This is all you need to know about this ****hole in Oklahoma

At least five sheriffs have resigned from the position since 2015.

Hearing to get Nowata County jail reopened ends in confusion over judge's actions. 'This was a flat ambush,' attorney says. | Crime & Courts | tulsaworld.com

I'd resign too, sounds like a disaster in the making that no one is looking to deal with. The sheriff seemingly can do little to nothing about it.

Edit - after reading the other article in this thread, it appears there is far more to this story... none of it good.

Its a county of 10,000 people with a median household income of $30,000. Were you expecting the county jail to be a resort?

I guess they succeeded in "drowning government in the bathtub" like they wanted. ;)

She did the correct thing. I have said on other boards that there is no right to strike against public safety, but she took the proper recourse: she resigned in protest.

Where do you get that impression from the OP?

Based on Fletch logic, prisoners deserve to be electrocuted or suffocated to death by carbon monoxide, and that equals, "adequate corrections facilities" because it's a poor county.

Murrikuh...**** yeah!

That's what you get in red states, nobody wants to pay for anything so they get garbage in return. Of course, god forbid they get non-violent drug offenders out of their ridiculously long prison sentences to save money and improve the prisons. This country's rate of imprisonment and justice/rehabilitation system truly is appalling.

Too bad that wasnt my point. But then again if I knew you were actually going to gather up the guts to comment on my post I would have written it in crayon so you would have a shot at understanding it.

You need to articulate your point much better.

I wasn't the only one that had no idea why you thought I was expecting the county jail to be a resort.

My expectations, if I have any here, are nowhere in the OP.

It was in response to the comment that >$1,000,000 was spent on public services

It wasn't a comment. That was a verbatim fact from the article. And the number is <$1,000,000.

Oh, you were spot on the first time, you can tell in every of his posts, they are nothing but dumb trolling. That response was the typical deflect from the OP by making some stupid comment and making up what the other side said and argue against that. Typical right wing tactic, employed by Fletch every single post

When I was living in Iowa, I remember a news story about a small, wealthy community in Nebraska full of farmers who elected only far right small government politicians who promised lower taxes. Eventually, the community ran out of money to maintain the streets and they ended up converting them all to dirt and gravel so they would be passable. Cut the property values in half. The farmers were trying to sue the local government. Never heard what became of it.

A departure from your usual medium, feces smeared on the wall. Sounds like you've made quite the upgrade.
If you're not careful, your handlers will see your pouty attitude and take your crayons away.
I normally don't have to work up to anything because I normally can't see your posts.

Yup, same here...I don't expect jails to be a resort either, but a trip to the pokey for a minor infraction shouldn't end with the violator going home in a pine box. Cruel and unusual punishment.

Nothing, they lost the suit and their streets remain "renatured" last I heard. :lamo

Thats the lack of guts I was referring to. But if that sort of lame retort is all you can manage, I havent been missing much.

You accusing anyone else of trolling is actually quite funny. I didnt deflect from the OP, I quoted and responded to it. You, on the other hand, are doing the only thing you ever do--trolling.

It's the USA, which is in so many ways a third world nation.

If it's dangerous to anyone's health...and that means it is to staff as well...then it's her responsibility to speak out. If you cant afford to contain criminals safely...then you dont do it. Besides, the assumption is that they are innocent.

And she's smart to leave before the administration can try to pin liability off on her.

Or a Federal Court tries to hold her accountable - or there is a civil lawsuit against her in a county that can't afford to pay her legal fees and any judgments.
