Middle finger protected by the constitution - US court

When it comes to the middle finger, police might need a thicker skin.

A federal appeals court says a Michigan woman's constitutional rights were violated when she was handed a speeding ticket after giving the finger to a suburban Detroit officer in 2017. The decision means a lawsuit by Debra Cruise-Gulyas can proceed.

In a 3-0 decision on Wednesday, the court said Taylor Officer Matthew Minard "should have known better", even if the driver was rude.

COMMENT:-

A victory for the voice of the voiceless?

Excellent use of the court's resources, settling the big issues of the day.

At its core it actually is an important issue. Can cops fine or harass someone for not arbitrarily curling their fingers the way the cop wants them to?

And your avatar condones animal abuse. Please change it.

iLOL Irrelevant attempt at rebuttal and my opinions are what they are.

You on the other hand, through your avatar, are purposely flipping everyone off. Which is offensive, uncivil, impolite and bypassing the word sensor.

Yeah, but my understanding is he gave her a speeding ticket that he had apparently previously decided not to give her (before she flipped the bird,) so it seems to me the question is: "Can a cop respond to rudeness by withdrawing leniency?"

We empower them to grant leniency, so the answer must be yes, they can withhold or withdraw it.

A rule against withdrawing it in the face of rudeness wouldn't be enforceable in the vast majority of situations anyhow, at least until we can read minds.

This is an appeal filed by the lady to protect her right to be rude and recover damages from receiving an enhanced speeding ticket?

It doesn't strike me as anything close to a important issue. Complete waste of resources on all sides.

I don't think the site senses bad words. Its an alphanumeric thing.

I am not joking around, the image is offensive.
If you are not joking please establish how the photo-shopped image condones animal abuse.

Does it sense animal abuse? It should.

I'm offended.

That poor kitten. I'm wondering whether they stapled that hat on, or simply used Gorilla Glue.

It's shocking, I tell you. Shocking.

Is it being shocked too? Damn that's ****ed up.

Animals cannot consent to wearing hats.

Animals cannot consent to wearing hats.
That does not establish a Photoshoped image as being offensive.
Your reply is like absurdly saying no elephant is actually the size of your avatar and therefore it is offensive.

Your reply is stupid. As already revealed, the image is photoshopped.

Your avatar is actually offensive. Please change it to one that is not.

Clearly a lawsuit is the only solution here, as well.

My avatar can't influence others to abuse elephants. Yours could influence others to non-consensually put hats on cats, which is animal abuse.

You are being silly, I am not.

Offense is taken, not given.
Being purposely offensive is that which is given and is irrelevant to whether or not someone takes offense.
