Police detain white people for being a dick all the time. They don't care what color that dick may be.

A black person has a much higher chance of police brutality. A much higher chance of being arrested, a much higher chance of being convicted and they receive, on average and with the same record, a longer sentence.

Are you completely ignorant of the statistics? Buy a clue.

I cannot speak much for the state system, my main connection there was municipal prosecutions where jail sentences could not be longer than a year but at the federal system, there is a rigorous investigation done called the Pre-sentence investigation that leads to a recommendation of sentence length that both sides can object to before the court. If a judge departs from the guideline sentence, the reasons for doing so have to be explained. Sentence variations usually resulted from

1) proven additional behavior-or related conduct For example if someone committed murder in the course of the federal crime such as kidnapping, and the murder involved torture etc-the sentence would be more severe/ In fraud cases, such as Ponzi schemes-the more money involved, the higher the offense level

2) the criminal history of the defendant played a major role-this was often where blacks ended up getting longer sentences in the matters I personally witnessed.

The stats are controlled for previous records and mitigating circumstances.

Racism exists in our police and justice system. Denying that is stupid. We're to believe that racism affects every aspect of society but not police and courts? Be real.

I don't deny it but I will also note that black cops, black judges and black prosecutors are often harsher on blacks as well. When I attended arraignments of defendants in the federal system, one of 2-3 (depending on the year and staffing) federal magistrate-judges (who are subordinate to trial judges-they are picked by the district judges-rather than presidentially appointed) would hear the arraignment and set bond for the defendant. For most of the years I was with DOJ, the district I spent the most time in had a black Magistrate-Judge. Both the prosecutors and the Federal Public Defenders office counted on that MJ to be tougher on bonding out black defendants than the white MJs. In the county where I lived, the state prosecutors I worked with (including several who rotated through one of the offices I was assigned to-we had state prosecutors to handle felon with gun cases and other stuff that was concurrent jurisdictions) and the best (from a prosecutor's point of view) state judges included 2-3 black Judges-they hammered black violent criminals.

I never asked those judges why-but one of the Federal Magistrate Judge's clerk became, himself, a MJ and he noted that his former boss was tough on black thugs because

1) He didn't want them running amok in HIS neighborhood

2) he wasn't worried about people calling him "racist"

I am not denying your assertions-I am just noting there are many reasons for the way black defendants are treated and its not always obvious

it can be due to racism or merely the life experience of the cop, judge or prosecutor

Same place racists get that "50% and only 13%" crap. Never looked that one up, huh? Just took their word for it, didn't look at the stats and didn't see the other 50%. It never even dawned on you there was another 50% and who knows who did that, huh? Well isn't that special. I bet you thought the other 50% was spread evenly over society. How ridiculous. It's such an obvious racist ploy. Well, for anyone who bothered to look at the stats.

That racist garbage has been around for decades, and the slightly learned have been debunking it always. You act like this BS came out yesterday. The generation before us dealt with it. But stupid racists will never stop pushing their BS on the ignorant who don't bother to check the stats.

You seem to need the clue. I said nothing about what your bleating about. I'm saying white people get detained for being a dick all the time. The police don't care what color you are if you're being a dick to them, you end up getting detained. Do you deny that?

The subject is not people being detained, it's black people being detained at a higher rate for the same incidents.

Smartest thing I ever did, along those lines, was in my mid 20s. A buddy had slipped a bag of grass and a pipe in my jacket pocket for my return trip to Oklahoma. I forgot about it. I get off the plane, go to a phone booth to call for my girl friend to pick me up, left the jacket in the booth and walked away. About 20 min later I realized I was missing my jacket, found it in the booth and as I exited a couple of airport cops detained me.

They started asking questions and the first thing that flashed in my mind was an article I read in the Whole Earth Catalog (this is 1978) that warned its readers to NEVER say anything except you want your lawyer. As much as I wanted to try to talk my way out of it, I followed that advice. They were pretty frustrated, asked a lot of stupid questions (like who was your drug contact you were supplying your dope too).

No matter, I refused to talk. They arrested and booked me with "intent to distribute and procession of drug paraphernalia". My lawyer got me off, pointing out that because I had abandoned the jacket for an period of time in the airport, anyone might have used it or planted evidence in it. It worked.

I did my own research and I didn't see anything about blacks being the primary victim of police brutality. It sure would be helpful if you back up your claim.

No, you turned it into that subject, as usual. The OP was When being asked questions, any questions by police, a good simple response could be, "I don't answer questions." For 26 posts, it was a 'race free' thread until YOU brought race into it. Get over yourself.

Again, police will detain someone acting like a dick to them, regardless of race.

I prefer being friendly to any law enforcement officer when they approach me because I don't give a **** about what he/she might be looking for, and I don't have anything to hide from them to begin with.

Anything you say may be used against you in a court of law, but none of it can be used for you.
Conclusion: Every time you open your mouth you are not accomplishing anything but the accumulation of risk. So why should you open your mouth at all, ever?

Of course as long as we're in the cynical corner, it should also be noted that the guy advising people let their lawyers do all their talking for them is a lawyer himself. :)
