The corporate owners of the Mandalay Bay casino filed suit against the victims of last year’s Las Vegas concert mass shooting, claiming it has no liability for the massacre, according to a published report on Monday.

MGM Resorts International went to federal courts in Nevada and California and took on more than 1,000 shooting victims, saying claims against the hotel giant “must be dismissed.”

“Plaintiffs have no liability of any kind to defendants,”

They may argue force majeure, but that will go nowhere, so they want to go to federal court. The Nevada supremes ruled against another MGM Resort -- New York - New York and lost an assault case resulting in injury to a guest. So they don't expect to prevail in Nevada state courts, so they want to go judge shopping at the federal level.

I just don't see a federal interest here.
 
Wow, just... wow. Going after the victims to remove the lawsuits, I am amazed that MGM is trying this.

I am not at all surprised; we are talking corporate America after all, where the all mighty dollar is much more important than anything, even human life .......
 
I do not see how MGM is liable for any of the damages done by the shooter. So I can understand them trying to get away from an "activist" type of court in which people will want to support the victims by getting a big company to pay for damages, if only because the company has lots of money

They went to federal court in order to make any litigation against them a class action suit instead of 1000+ individual cases. The reason they could be held liable, in any court, is if they failed to provide adequate security at the hotel, and somehow this security should have identified a potential shooter. In this case they didn't provide security at all, I believe they contracted with Homeland Security. I personally don't see how the hotel could be liable, but stranger things have happened. They were smart to file this lawsuit.

In jury trials, I can see the jury seeing MGM having tons of money, and the shooting victims as being very sympathetic and needing money.

And civil trials have a much lower standard of evidence than criminal trials. Good CYA move by MGM.
