How is this a crime?

You asked a question. I answered it. Did you want something other than an answer?

I don't even understand what you're talking about in your most recent comment above...What has your sexuality or anyone else's to do with what one calls a man who cleans rooms?

You would have to read my post explaining how the note got there in order to understand that last comment.
It has nothing to do with my sexuality.

I have to wonder about this. It's not like people in the US are not used to seeing black guests at hotels, even upscale ones. So, not sure I'm buying this one at face value yet.

After reading the story imho it sure seems a tad contrived.

Don't upscale hotels have cameras in every hallway? Shouldn't it be simple enough to determine who entered that room and when?

No, that does not sound plausible.
Further reading of the article states.

Kind of suggests the note was not there when the man first got the room. But was placed after he left the room for breakfast.

An the crime at the very least would be trespass.

How does somebody "sneak" into a hotel room with the security measures they now have?

Sounds like it would be easy to find who did this. The pool wold be very small.

It might be easy to narrow the suspects. Proof is a different matter. And the way americans run to lawyers at a drop of a hat accusing someone without poof is a litigation waiting to happen.

Breaking and entering. Trespass.

And it can also be considered a threat. "I can get into your room, next time it will be more than a note."

Laws really vary on threats tho.

If I had to guess, the note was left by a previous guest knowing eventually a black person would be the next guest.

It's where someone can see it...so all non-black subsequent guests and maids would just leave it there? :doh

Having the matter remain an unsolved mystery (cold case?) let's everyone off the hook. The guests can still successfully claim to be victims of racism even with an unknown perp.

I can see this as a possibility.

Esp. if there is a report of any issues the hotel guests had with the hotel/chain.

It could even lead to a settlement. Or just getting the room comped.

a take on 'waiter, there's a hair in my mashed potatoes!'

An African-American millionaire and his Manhattan consultant son were victims of a July 4th hate crime in their hotel room during a Florida vacation. A racist creep apparently snuck into Frank and Michael Davis’ room at the upscale Art Ovation Hotel in Sarasota and left a 2-by-5 post-it note.

I suspected this was done by one of the employees of the hotel who accessed his room, such as a bellboy or cleaning lady. After an internal investigation, the Art Ovation Hotel is now saying the racist note discovered by an African-American family in their hotel room on the fourth of July was left by a previous guest and was not directed at the family. The person of interest was also behind other incidents at the hotel including unlawful fire alarm activation and this previous guest may have committed some crimes.

'I am relieved to report that a person of interest has been identified by Marriott in the incident at the Art Ovation Hotel. The person of interest was a guest at the hotel who had been using the N-word to disparage Marriott associates and others at the hotel,' Davis, 58, said to the Sarasota Herald Tribune in a statement
