Florida prosecutors have charged a Miami police officer they say tried to kick a suspect who was being handcuffed on the ground, in an encounter captured on video.Mario Figueroa, a two-year veteran of the force, was charged Tuesday with assault, a second-degree misdemeanor, after the cell phone video of the incident surfaced last week.
"Officer Mario Figueroa can have no excuse for the alleged actions seen on the initial videotape," State Attorney Katherine Fernandez Rundle said in a new release. "This community demands respect for all individuals taken into custody."




First of all it should be attempted murder, not assault. The victim was on the ground and the cop soccer ball kicked.

Second... We need to start charging these cops with felony when they commit crimes while having a gun, like they do to gangsters and drug dealers. Commit a violent crime while possessing a gun? FELONY.
 
I agree, he should be charged with attempted murder. A kick like that to the head can break necks or crush skulls.

A kick like that can break a neck or cave in a skull. So yes, to kill.

If you have a problem with the definition of murder address that instead of saying that something that is not attempted murder is attempted murder.

In order for a person to be guilty of attempted murder, that person should have deliberately, intentionally or recklessly with extreme disregard for human life, attempted to kill someone. There should be some substantial step towards committing the crime.

Choking someone is also attempted murder. You could accidentally crush their wind pipe. And doing it while in possesion of a gun should upgrade the felony. This cop needs at least 10 years. Just as if some gangster with a gun choked someone viciously and slammed them to the ground.

Have you ever been choked? When it happeend to me I automatically started kicking the dude in the stomach as soon as i couldnt breath and he slumped back so I kick him in the chest and he slumped back more and I kicked him in the face. All without thinking about it.

We need emergency laws to combat the section of police that commit crimes. As fast as possible.
