Attorney, author, and advocate Wesley J. Smith writes a blog at National Review entitled “Human Exceptionalism.” Here, he writes that the author of Delaware’s proposed assisted-suicide bill has been amended to include the “intellectually disabled” when, by definition, many of them are unable to fully comprehend the issue.
If a licensed social worker says in writing that the person fully understands, then he or she is “eligible” for assisted suicide. If someone is mentally incapacitated and cannot enter contracts or vote or make their own medical decisions, how can they consent to assisted-suicide?
Smith says:
Yet, if they have a terminal illness, they are going to be able to commit assisted suicide if a social worker–who may be ideologically predisposed in favor–confirms that they “understand” that they are receiving a poison prescription? It doesn’t even require approval of a guardian, as would corrective surgery or treatment to cure or palliate.

I don’t keep up with Delaware politics and am hopeful somebody more familiar with bill author Representative Paul Baumbach can offer insights on him and how likely this bill is to pass.
