No jail time for kidnapping and torture.......

My bad if it was already discussed but hadn't seen the thread.

I would say I am shocked but stuff like this doesn't really surprise me anymore.

It seems insane that a judge gets to decide that this convicted person would not benefit from the jail/prison experience yet another convicted of exactly the same crime spree may. It will be interesting to see the sentencing used for the co-defendants in this case that appear more reluctant to accept plea deals.

EDIT: BTW, the kidnapping charge was dropped for this little angel.

His comments about why he didn't give her a prison sentence was the most ridiculous thing I have ever read.

I wonder how sympathetic he would be had the races been reversed.

My concern is more about equal protection/application of the law - does this judge always decide that probation is the best initial option for felony convictions. How many of his little angels have violated their probation and, in the process, accrued more victims? What disturbs me the most is that the judge appears to treat the law and sentencing guidelines as taking a back seat to his infinite wisdom and excellence in judging a convict's character.

Chicago jails (Illinois prisons?) must be really bad places if even those that confine and torture their victims are given probation rather than being placed in them - what, exactly, must one do to deserve jail (prison?) time from this judge?

Yeah, that whole dropping the kidnapping charge was some BS if I have ever seen a half assed decision brought down by a judge.

She was part of the group, she eagerly participated. She deserves the full force of the law.

I don't see race as having much, if anything, to do with it. A hate crime enhancement is appropriate for the mental disability of the selected victim. Even without any hate crime enhancement, the felony kidnapping and torture (to provide online entertainment?) convictions are certainly enough to warrant a sentence of many years in prison.

Sometimes the state must cull one perp from the herd in order to get them to testify against the others but that much of a plea deal seems unnecessary when you have such solid video evidence.

I just highly doubt that judge would let a white person off with community service if he/she were involved with kidnapping and torturing a black person. Any judge that lets someone like that (regardless of race) walk after such a heinous crime should never be inside a court room again.

Don't you think that protesting different sentences given for the same crime is appropriate? Several of us seem to be doing that - although our objection is to the very lenient sentence given for someone confessing to multiple felony charges.

Had the races been reversed and the same ruling rendered, there would have been protests in the streets and with riots and arson, as we have seen in Baltimore and Ferguson.

But I suspect that had the races been reversed, it wouldn't have ended with this ruling.

White privilege has it's draw backs I suppose.

Interesting to note that those who take an affront with White privilege don't bother with the flip side of that coin, and remain silent with rulings such ass this one.

Race relations have indeed take a giant step backwards during the Obama term.

Howard, the ringleader, “also posted a confederate flag on the plaintiff’s computer and demanded he learn and recite a racist song titled “Moonman Notorious KKK,” KTVB reports.....

It is a town in turmoil, thrust into national headlines by a tale of racially charged violence and negligence graphically detailed in a $10 million lawsuit the McDaniels filed last week against the 230-student school district. The suit claims that three players on the high school football team sexually assaulted a mentally disabled teammate — a son of the McDaniels — with a coat hanger, which they kicked deep into his rectum. The three alleged assailants are white; the McDaniels’ son is black.

The McDaniels sought legal help soon after the alleged Oct. 22 assault, which the suit says followed months of escalating race-based bullying that coaches and administrators allegedly ignored.

The tormenters, allegedly led by football star John R.K. Howard, a transplant from Texas with ties to a prominent Dietrich family, forced the victim to recite words to a racist song, called him racist names and, in full view of coaches, physically fought him as part of a “toughening up” program until he fell down unconscious, the lawsuit claims. The players were expelled in November and criminally charged in March.

How are all these people getting away with crap like this? I could understand community service for shop lifting or some other small crime but to violently assault someone and receive no punishment is beyond absurd to me.

Yes, it is very lenient and if they all don't get the same sentence, or at least something comparable to equal between the four of them. Then it is a gross disservice to that young man.

I am just holding fast to the ideal that these four criminals should be held accountable for their own actions and hit with the full measure of the law.

Kidnapping and torture is what the CIA does when it's not smuggling drugs. The architects of rendition and torture, men like John Yoo and Tony Gonzalez, were given awards for presenting sophistry in support of rendition and torture.

If they were given awards, should this woman also be given one? If the CIA can do it, why can't she?

Her award should should be a lengthy prison sentence and then after that some time in a psychiatric hospital because she is clearly a deranged individual.

I haven't heard of any CIA agents kidnapping and torturing people purely for entertainment, if so I hope they get locked up as well. Not really sure what your point is.

The Italians tried a handful of CIA guys for rendition years ago, obviously in absentia. Whether for entertainment or following orders, we would have to depose the agents themselves.

Nonsense, they didn't post it live to Facebook. The criminals that kidnapped and abused the poor guy in this case did so and openly bragged about what they were doing. Please stop with the red herring propaganda.
