Two days before Harvey, while walking from the transit train to the 7/11 across the street in Miami, I witnessed a police officer with his baton held high over his head in a striking position, threaten an old homeless man. The cop wanted him to leave and the old man was yelling. I thought how can this be legal? I was so offended!

Should laws be changed to more easily prosecute cops for beating people?

I'd be more likely to believe this if you were saying the cop pointed the gun at the homeless man and threatened to shoot him.

It doesn't appear as though you were involved in the situation at all, so how do you know the homeless man wasn't doing anything wrong? He could have been guilty of something. It's dangerous to assume something like police brutality without proof of innocence of the victim.

Who was beaten in your little tale? Was the cop assaulted before you "arrived"? Why didn't you say something to the cop to put a stop to such an "injustice"?

I'm thinking this was all made up.

The burden is always on law enforcement to prove that a suspect has committed a crime. Not that suspect to prove they are innocent. This is isn't Russia. If the officer is trying to get him to leave, that means he hasn't detained him and the homeless man isn't threatening him. Officers have to follow a protocol before force is used. That protocol begins with detaining the homeless man. Which means he couldn't leave if he were being detained. Ergo, threatening to beat the homeless man, would be brutality.

They think they can do this. Not shoot you, just beat you.
It's on TV every day. It's a given. I don't need to prove this. It's self evedent.

I haven't seen a cop beating anyone on TV and I watch TV nearly every day. And you didn't see a cop beating anyone in your little story.

If the cop were assaulted, he wouldn't be trying to get the man to leave. He'd be on the ground wrestling him and calling for backup. It doesn't sound like the man was being detained or arrested. Even if this is a hypothetical, from the parameters of the hypothetical, hypothetically the cop would be in the wrong. They can't just beat you for yelling at them. If they feel you are a threat, they would start by detaining you. If you resisted then they can beat you. But if they detain you, you can't leave.

They were threatening an old man with a club to get him to leave the transit area. I guess the cop was a p**** for not, 1) beating him, 2) not coecing the old man to leave without beating him.

Oh I didn't realize that a cop can beat you for just any crime. I better watch my jaywalking in the future, lest the long arm of the law decides to dispense some old fashioned justice sans due process, or any of the other rights I theoretically enjoy.

Not so much. I saw this today, but this still doesn't speak to "every day" which was the claim that was made.

Well, to be fair in how you worded it.

I haven't seen a cop beating anyone on TV and I watch TV nearly every day. And you didn't see a cop beating anyone in your little story.

Your wording indicates you haven't seen a single video on tv, and you claim is that you watch tv everyday. So wording mixup?

Out of curiosity, how many videos would you need to see before this became a concern for you? And do they have to be homeless people, or just any pedestrian failing to comply without being detained.

And that is perfectly fine, I support officers giving homeless people a bed and a meal under the guise of arrest when it's really cold out, or a hurricane is coming in. But in the, let's call it a hypothetical, situation above threatening a homeless man with a billy club so they move is crossing a line. If they refuse to move, arrest them, if they resist, then use minimum amount of force necessary to accomplish the arrest. Don't come out threatening violence. That's not protecting, or serving anyone.

Self defense would be the only reason for a cop to hit someone over the head with a club. That can be a death blow... I wouldn't be surprised if they have policy about striking someone in the head withna club regardless. You're right to be concerned.

Nobody has seen the video of the nurse being roughed up in Salt Lake City. Nobody's heard of the black lives matter movement?

I saw on You Tube a homeless women being beaten mercilously by a cop for begging.

It is on the news damn near everyday and it is a crises! When did people become so selfish that they're not outraged at the abuse of power? If it's alright to beat you then surely you wouldn't mind if they raped or stole from a loved one

Did you report the cop? Not sure what you'd report, though. You are assuming the Youtube videos you've seen didn't result in charges against the cop. I wouldn't be surprised if many of them did. There are bad people in every profession, DS. And there are certainly bad cops out there.
