Castle Doctrine can be interpreted that you can shoot anyone in your home regardless. You really never know when someone that is retreating might suddenly become a threat. However...in your yard...or in your driveway...thats a different set of rules.

LEOs shoot & even kill citizens retreating, they do it all the time & walk; civilian citizens should have the same protections, IMO .........
 
I think he's F'd and the remaining years of his elderly life will be in custody.

About a year ago here in my area, Mason County, Washington we had a guy who owned two adjacent houses, he owned one as a residence and based a business out of the other. He had them all signed up "trespassers will be shot" etc whatever. So some guy who's a special ed teacher from Woodinville (an upscale Seattle suburb about 30 miles from here) is at a party at a neighboring house, gets drunk, and wanders off his friends house and into the second house and starts taking a shower, the owner goes in, hears the shower, goes back to his residence house, gets a pistol, doesn't call the cops goes back and shoots drunk special ed teacher through the shower curtain. Take a wild stab how that ended for him.

Well it hasn't ended but he's on the docket for a murder trial

I wouldn't want to find someone in my house, uninvited, in my shower; I would prolly shot them too ............... good job IMO ............

Yeah but the house he was in was not occupied, the owner owned two houses that were next to each other, lived in one and not the other, it was the empty house this happened in

When you start of with a false narrative, why should anyone read the rest of what you say?

You destroyed your integrity saying he was told to "stand down." Saying that is a lie. They said "we don't need you to do that." or something to that effect.

Based only on what was in that article, I'm betting the guy will be convicted. The evidence available so far points to him being a guy with a history of legal problems who was itching to shoot someone and finally got a chance to do it. There seems to be no evidence that supports the fact that it was a valid self defense shooting.

However, based on your statements.. I don't think castle doctrine applies in your case.

IMO, at least two major issues factor into a likely appeal: 1. The documented history between the Manatee County Sheriff's Department and Eugene Matthews... 2. Judge Brian A. Iten, a former prosecutor, has faced dozens of challenges based on possible ethical conflicts. During one three month period in 2017, the judge recused himself from 30 cases.
