Congrats you are defending a pedophile. I just did a search and found this article from a month after the one linked in the OP.

Forensic examination also disclosed that Doe [Rawls] had downloaded thousands of files known by their "hash" values to be child pornography. The files, however, were not on the Mac Pro, but instead had been stored on the encrypted external hard drives. Accordingly, the files themselves could not be accessed.

The court also noted that the authorities "found [on the Mac Book Pro] one image depicting a pubescent girl in a sexually suggestive position and logs that suggested the user had visited groups with titles common in child exploitation." They also said the man's sister had "reported" that her brother showed her hundreds of pictures and videos of child pornography. All of this, according to the appeals court, meant that the lower court lawfully ordered Rawls to unlock the drives.

A child-porn investigation focused on Rawls when the authorities were monitoring the online network, Freenet.

5th Amendment doesn't apply because it's a foregone conclusion there is child pornography on the drives. Not because of just his sister, but because of forensic evidence.

Unlike you, I respect The Constitution no matter what. The 5th amendment always applies and if it's such a "foregone conclusion" then convict him in the court of law. Don't hold him indefinitely. It's ridiculous that anyone would support holding a person in prison forever based on speculation. I hope you plan to renounce your citizenship and go to a lawless paradise like Afganistan or Somalia where your ideals are welcome. In this country what you're advocating is despicable.

No, it wasn't found after the fact. They started investigating him after he turned up on freenet. And the fifth doesn't apply because he wouldn't be testifying against himself as it is a forgone conclusion that the material on the hard drive is child pornography. And under current law, they can compel him.

Somalia sounds exactly like a place more fitting for you. Here in America people are innocent until proven guilty. Why isn't the government taking this to trial if his guilt is a "foregone conclusion"? Yep, there's nothing there at all and the prosecution and judges are using hyperbole. This definitely should be sent to the Supreme Court and it will definitely be struck down. If it's not speculation, if it's practically a foregone conclusion, then let the innocent suspect have his day in court. I'm horrified that there are people like you in this country.

The prosecutors and judges can't even get their stories straight. This is what destroys our country. Not terrorists.

Here are some things that are foregone conclusions without requiring further investigations...

What color is the sky?
Will the sun rise in the east?
2+2=?

There is no "but we cannot know for sure" when something is a foregone conclusion.

From what Ive read his activity on freenet, which they monitor. Even if it was his sister, wouldn't matter, he's guilty.

If there's evidence charge him. Don't hide behind "it's a foregone conclusion" while also saying "but we just can't be sure". Why is it so hard for you to understand holding an American citizen indefinitely without charges is morally reprehensible?

They have more than enought to charge him, but what you fail to understand is that they need the material on his harddrive to identify the children, locate them, and arrest the sickos that made the porn in the first place. If they just go ahead and charge him they are not doing everything they can to help the real victims.

If you have a problem with US law as it pertains to the forgone conclusion doctrine take it up with your congressman. Explain to him/her how you think this pedophile is being treated unfairly for protecting his fellow pedophiles.

LOL my hard drives on all my computers are all encrypted and it is the first thing I do with a new computer and I am not willing to allow anyone including government agents to access decades of my most private through and feelings.

An that go even those as far as I know there is zero illegal matters on those computers.

Applying the name/label pedophile without any proof that would allow a conviction to take away the basic rights to privacy is outrageous in every way.

Sorry a family member with an ax to grind is not proof but if they can convict a jury to think otherwise that would be fine also but what is not fine is keeping someone in jail in the hope that he does have child porn and will be force to surrender his constitutional rights and aid his own conviction.

The government had such little respect for the constitution that the FBI had set up a tip fund for the technicians that work in Best Buy to search at random their customers hard drives of the computer given to them for repair for child porn.

Random searches that are completely illegal if the FBI itself does it but at the moment a gay area as far as paying someone else to do so.

Police state here we come.............

Criminal law is not about the accused proving their innocence it is about the state proving guilt beyond a reasonable doubt.

I agree with you. But I also think it's pretty damn unlikely this guy is willing to do 16 months in jail just on principle.
