It is the rules that they follow put forth by city officials.

On this, Helix, we both agree. It's egregious. Once the assets have been seized by LEOs, doubtful they'll ever be returned to the rightful owners.
This makes the LEOs appear to be a criminal enterprise, and they don't need the bad press right now.
Far too many people are already gunning for them, needlessly making an already dangerous public service job even more so.

Even with conviction, it should be proven that the assets were acquired with money from illegal activities. If it can't be, then people should not lose their entire livelihood.

Asset forfeiture right now is like the Home Shopping Channel for police.

There are too many cases where people had a certain amount of cash on them and it was assumed they must be doing something illegal, so the cash got seized. Legal tender is apparently proof of criminal intent these days.

Funny.... when someone illegally searches you and steals your money, they are wearing a uniform and a badge and calling themselves the police......

Yes it is the police. They steal the money, and in most cases they keep the money.

i don't think that the police are a criminal enterprise. most of them are good people doing a dangerous and tough job. however, this forfeiture thing has tons of potential for abuse.

There might be a few corrupt cops on the take, but overall they follow the rules set forth by the administration.

Please prove to me where there is a widespread take by cops themselves?

there should be no forfeiture without conviction. i'm not sure how we could possibly disagree on this point.

You have used the word "police" in the confiscation issue.

The police are only the people on the ground in the overall picture, and I believe that you know this?

Cops do not make the rules, they only enforce what they are told to.

OK let me teach a little school here..... You served in the armed forces so you should already know this but if you do you are not being forthcoming about it.

Officers take an oath when they are entrusted with the special powers the public entrusts them with.

In the military this oath is broken down between Officers and enlisted men. They have different oaths. The enlisted men swear to uphold the Constitution and to obey the orders of the President and the Officers over them. The Officers swear only to uphold the Constitution. This is done for a reason. An officer is required to obey the Constitution above all and to disobey any order which is contrary to the Constitution.

Civilian Government office holders and police are also considered OFFICERS because of the powers entrusted to them.
Police are ALL Officers. They pledge to uphold the Constitution regardless of orders. If an order is in disagreement with the Constitution then the Officer must follow the Constitution. If the Officer by his own choice refuses to obey the oath he took to uphold the Constitution then he is a criminal.

This is exactly what is happening with asset forfeiture...... The cops are stealing peoples property without due process in violation of the 4th Amendment. They know it and we know it. THEY ARE CRIMINALS!

You think an oath is crap? Is that what you thought when you took it? An oath is the most solemn word a person can give. If a man's word is worth nothing then neither is the man.

Cops are Officers. Officers take and oath to uphold the Constitution. Being a cop is not a job. It is a position of power. If they abuse the trust and the power the people entrust them with they are scumbags and criminals and that unfortunately is what the vast majority of them are;

You have been publicly humiliated so now if you have any pride and dignity you will admit you are wrong and find another subject you are better educated on......

Police Officers are not officials. I noticed that you skipped over that part while trying to further your bogus argument. Your article spoke about officials. Perhaps you are the one who should further educate yourself before making a fool out of yourself. Who is it taking the peoples money? The officials? No the COPS! The Cops and stealing the peoples money! The same cops who swear on their honor to uphold the Constitution are betraying their oath to the people. They are criminals and POS's. They deserve none of the peoples respect, they deserve to be in jail.

There are thousands of articles out there how the fed's and local municipalities use forfeiture laws to produce revenue.

I suggest that you research this before you go calling other people ignorant.
