asset forfeiture without conviction should be ended nationwide.

And zero proceeds from asset forfeiture should be going to the Police directly. Talk about conflict of interest x 10.

Our justice system and police system has turned into a clown show.

I want the absolute abolishment of civil asset forfeiture, but if we have to have it it should not go directly to LE. The profit incentive is a solid conflict of interest.

The police steal millions of dollars a year from citizens in the name of "asset forfeiture". This is nothing more than government sanctioned theft.
The police have now become the robbers and there is nothing you can do about it.

And your Supreme Court has long been fine with it.

As well as most American citizens.

Funny.... when someone illegally searches you and steals your money, they are wearing a uniform and a badge and calling themselves the police......

It is the rules put forth by the state, county or city officials that enables this heinous policy. It isn't as simple as "the police stole money". They don't take money and keep it. They take money because of the policy that allows them to take it and the city, county or state keeps it. To solve a problem one has to look that root cause of the problem. Those policies need to be outlawed.

I agree that "asset forfeiture" should have been stopped years ago but I also think people should have some idea what the word "steal" means.

To steal is to take by force without the consent of the rightful owner. That is what government does.

Police Officers are also not constitutional scholars or lawyers..

If those people... you know... the Judges and such.... have stated that asset forfeiture is constitutional, then the Police are therefore "upholding the constitution".

If the police are not smart enough to understand the law, then they are not smart enough to enforce it.

The Supreme Court is corrupt and owned by the same corporate cartel that owns the rest of the government. The average citizen is a programed droid who believes whatever the TV tells them to believe. As a country, we deserve whatever evil we have created by our own lack of integrity.

If the police are not smart enough to understand the law, then they are not smart enough to enforce it.

Again..... when the judges who determine if the law has been followed state that it is constitutional... you know legal scholars, then how are the POLICE the ones who are "not smart enough to understand the law".

So you expect law enforcement officers to think they know better than law school graduates on what the law is and is not.

I want you to address the lawyers aspect of this and acknowledge it rather than just call someone "not smart" and move on. Otherwise..... I will accept that you have conceded the point.

I think it goes beyond being smart or not. Certainly specific knowledge of the law is necessary to be a police officer, but a strong conscience (knowing right from wrong) is also necessary. IMO, it's the conscience aspect that seems to be lacking so often these days.

When ever people seek positions of power over other people, it is very important to examine their motives. In most cases, it is people with psychopathic tendencies that seek to have power over others.

There is a reality you are failing to understand.

Judges and Justices of the various courts make decisions on issues brought up before them. These decisions become the basis of what the police are and are not permitted to do, regardless of the "OMFG THE WAY IT WAS WRITTEN PLAIN ENGRISH!!!!!!one!~!!!!!" that you keep spouting. Because you see, if judges and justices of the various courts have created a precedent on how a particular situation is handled, and officers continue to do it the way THEY think is constitutional, that **** will get thrown out of court. So you see, justices and judges case decisions dictate the manner in which law enforcement conduct business, as they clarify various parts of the constitution and how they fit a particular situation.

So, if judges have determined that asset forfeiture is constitutional, and a police officer's supervisor demands that he seize property pursuant to the law, which has been upheld.. he has a choice to make. Seize the goods and keep his job. Refuse to seize the goods and either get, or be one step closer to, losing his job.

Nobody's **** is worth the financial security of my family.

Actually, data gathered in the Stanford Prison Experiment back in the 70's shows that it is quite a bit more complex than what you say. Philip Zimbardo conducted the experiments, and has written a book about it called The Lucifer Effect. If you're into human behavior, it is fascinating reading.

Again.........

It is not the police.

It is the rules that they follow put in place by administrations.

Or by the departments themselves. In any case the police have discretion which it has been proven time and again they fail to use. Asset forfeiture is a taking without due process, and hence unconstitutional.

We have a country full of idiots. Idiots will debate anything. Some idiots think animals have rights. Some idiots think the government works for the people. Some idiots think what they see on major media news is the truth. The fact is that the average American has their head so far implanted in their anal orifice they are incapable of understanding the simplest of concepts. The concepts of freedom and liberty are far beyond the understanding of the vast majority and thus the wealthy treat the masses like the irresponsible children that they are.

LOL.... Mindless drivel is someone who seems to think that police officers are dumb because they aren't better versed in the Constitutionality of Laws than Judges and Justices of the various District, Superior, Appellete and Supreme Courts, in both Federal and State judiciary branches.
