In most cases, I agree with you on the issue. Losing a car or house over petty drug charges isn't right.

The police steal millions of dollars a year from citizens in the name of "asset forfeiture". This is nothing more than government sanctioned theft.
The police have now become the robbers and there is nothing you can do about it.

I agree that "asset forfeiture" should have been stopped years ago but I also think people should have some idea what the word "steal" means.

You think an oath is crap? Is that what you thought when you took it? An oath is the most solemn word a person can give. If a man's word is worth nothing then neither is the man.

Cops are Officers. Officers take and oath to uphold the Constitution. Being a cop is not a job. It is a position of power. If they abuse the trust and the power the people entrust them with they are scumbags and criminals and that unfortunately is what the vast majority of them are;

You have been publicly humiliated so now if you have any pride and dignity you will admit you are wrong and find another subject you are better educated on......

Police Officers are also not constitutional scholars or lawyers..

If those people... you know... the Judges and such.... have stated that asset forfeiture is constitutional, then the Police are therefore "upholding the constitution".

All the cops that I know have little taste for confiscation and all the paperwork involved. And...... the cops do not have any control over the process as it is controlled by state and federal laws.

If it is the police stealing your property then it is the police doing it. Who makes the rules is irrelevant.

I say again, the record is very clear that many police agencies around the nation have been happily playing the asset forfeiture game. Corvettes, boats, airplanes, and of course currency. Old story indeed, very well documented over the years.

ACLU and other groups have been fighting it for years. There was a group called FEAR, an acronym for something about forfeiture. IJ, Institute For Justice, has been fighting the abuse for many years, and been successful in a number of high profile cases.

Police departments... made up of common street cops... by and large, also actively advocate for civil forfeiture laws, especially where they get to keep the proceeds. Whathisname here is being willfully obtuse when he refuses to recognize police complicity in the overall scheme.

Of course the police brass are all for civil forfeiture laws. They are also the ones who are "highly encouraging" officers to complete the paperwork to seize property that they didn't want to seize (in such cases).

A little research shows me that there is some cops/admin/departments that take advantage of civil forfeiture laws,, I read an article on several innocent's getting large amounts of cash seized ( anywhere from 11K and up) Most eventually get the money back after a long legal battle. interestingly enough these people were stopped ( for one reason or another) and had these large amounts of cash "on Hand",, While you should be able to carry large sums of cash on you,, why take the chance? I can in theory hug the center line when I drive my car, as long as I don't cross i should be OK, but I don't.

I don't really have a issue with property seizure when a large drug bust, or crime ring of some sort is busted, but stolen cars ( or property) used in these types of crimes should be given back to the proper owners ( and in short order).

Any cop that seizes a car/boat/motor cycle and then uses it for his own gain is just wrong,, And they should be called on it.

My favorite cops are those brave men and women who have put their reputation on the line by supporting LEAP, Law Enforcement Against Prohibition.

Cowards and accomplices keep their mouth shut and don't rock the boat.

So when one puts on the badge, one is entitled to abandon his conscience, his ability to know the difference between right and wrong, and any obligation to do the right thing?

Even with conviction, it should be proven that the assets were acquired with money from illegal activities. If it can't be, then people should not lose their entire livelihood.

Asset forfeiture right now is like the Home Shopping Channel for police.

There are too many cases where people had a certain amount of cash on them and it was assumed they must be doing something illegal, so the cash got seized. Legal tender is apparently proof of criminal intent these days.

The chip in your debit card reports your transactions. That plus a credit card or two is all you should be allowed to have. Anyone with a large amount of cash on their person must be associated with crime. poe me

Well if there is no conviction.. then it could certainly mean that the COPS ARRESTED THE WRONG GUY AND CONFISCATED THE WRONG PROPERTY.

that means they bear some responsibility.

Totally. Two stories. when I was much younger.. a woman I worked with.. was driving the guy she was dating in her BMW convertible. He said "I need to stop for a minute at my friends office" (they were both attorneys).

she did... and waited in the car. He came out and they drove off. He had done a drug deal on tape. They confiscated her car saying that it was used in a drug deal. She lost it even after appeal.


Another.. I patient of mine raises marijuana in a state that's legal. He suddenly had police at the place he raises he marijuana. They broke a door down when he told them he would open it for them. They confiscated his growing lights, and other stuff about 50,000 dollars worth of property.

The DA told him that they would not charge him if he agreed to forget about the growing lights and property.

My transactions are not the default business of the government. I use my cards knowing that they can track them, it is a willful permission I grant them every time I use my cards. If I want to pay for something in cash, that does not automatically make me a criminal.

What makes a transaction legal or illegal is the nature of the transaction, not the nature of the legal tender used to broker it. Good thing someone like you doesn't write policy.

The system you propose is the one we are heading for though, and it's the reason why the financial institutions have an obscene amount of power over every day people. The very ability of every day people to sequester cash is a threat to them, which is why police enforcement has been twisted to associate crash with criminal activity, without any real right to defend oneself.

You might want to contact the mods and file a report. Someone hacked your account and labeled you as a Libertarian.

Yeah, I think it's a joke on me.

They really wanted to insert the chip into people's arms. That way, when you turn 'location' off on your phone, they will still know where you are. You've heard of house arrest? Big Brother would like to place all citizens under life arrest. Anything done electronically can be data mined to look for anything and everything you can possibly imagine.

It used to be that you could jump bail in one state, move to another state, and be anonymous. Not anymore.

It my tin foil hat on straight?
