As long as the Palestinians' elites want the Israeli state gone and toss bombs and rockets, it isn't very legitimate to reprimand the Israeli foe the way they order their affairs. And as long as the UN isn't willing to guarantee the security of the populations in a believable way, they do not really have a leg to stand on.

As long as the Palestinians' elites want the Israeli state gone and toss bombs and rockets, it isn't very legitimate to reprimand the Israeli foe the way they order their affairs. And as long as the UN isn't willing to guarantee the security of the populations in a believable way, they do not really have a leg to stand on.

Each side is responsible for its own atrocities. You can't just hand-wave away human rights violations.

Well consider the position of a Palestinian living in the West Bank along side Jewish settlers, both live under the nominal jurisdiction of the Palestinian authority. But the state of Israel has the power to detain the Palestinian without trial, decide whether or not he can leave his house, or his town, and decide which roads he can use or reserve some exclusively for settlers. And yet the only people allowed to vote for the state that makes these decisions are Isreali citizens, who suffer none of the consequences. Whether Apartheid is an apt comparison is uncertain, but what is certain is that if you look at Israel and the occupied territories as a single unit, then its clearly based on a legally defined system of discrimination in which your interactions with the state are defined by your race.
 
UN agency head resigns, stands by Israel 'apartheid' report

'BEIRUT - The head of a United Nations agency that promotes development in Arab countries resigned Friday after refusing to withdraw a controversial report concluding that Israel has established an "apartheid regime" that discriminates against Palestinians.

The report titled "Israeli Practices Toward the Palestinian People and the Question of Apartheid," which was published earlier this week by the United Nations Economic and Social Commission for Western Asia, drew swift criticism from U.N. and Israeli officials.

Its authors concluded that "Israel has established an apartheid regime that systematically institutionalizes racial oppression and domination of the Palestinian people as a whole."

Rima Khalaf, a Jordanian who heads Beirut-based ESCWA and is a U.N. undersecretary-general, announced her resignation at a hastily called press conference in the Lebanese capital, saying she couldn't accept being subjected to pressure from U.N. Secretary-General Antonio Guterres to withdraw the report.

She described the report as "the first of its kind," adding that it "concludes scientifically and according to international law that Israel has established an apartheid regime."

"It was expected, naturally, that Israel and its allies would exercise immense pressure on the U.N. secretary-general to distance himself from the report and to ask for it to be withdrawn," she said.'

No Israelis live under any Jurisdiction of the PA, area C is under Military Jurisdiction.

Israel does what is necessary for its security needs, back in the 80s not only that Palestinians traveled freely in the entire west bank they also traveled almost freely in Israel.
Saying Israel decides whether an individual can leave his town is not quite accurate, Israel can only control and only cares about travel into area C.
Saying Israel can decide whether a Palestinian can leave is house is completely false because it doesn't have any jurisdiction over area A

And yet the only people allowed to vote for the state that makes these decisions are Isreali citizens, who suffer none of the consequences.
The Palestinians vote for the PA. and Israelis don't vote for the military governor of the west bank.

It is, the answer is that its not.

but what is certain is that if you look at Israel and the occupied territories as a single unit, then its clearly based on a legally defined system of discrimination in which your interactions with the state are defined by your race.

Race is most certainly not relevant to the question here, and not even Ethnicity. If you look at Israel and the West Bank as a whole, Arabs with Israeli citizenship have full equality with Jews or other races who have Israeli citizenship. Arabs who live in East Jerusalem can enjoy this equality if they choose and Arabs who live in other places in the West Bank don't. So the differing characteristic here is nationality.

Except this isn't true, of course, since a very large portion of Israel's citizens are Arab Muslims and you have lots of folks of all different sorts of races (including half of Israel's Jewish population who are from the Arab world and were part of various expulsions and ethnic cleansings over the preceding decades).

Yeah it sucks that Israel was forced to occupy the territory because of repeated Arab efforts to destroy it and yeah it sucks that the Arab world refused to negotiate with Israel in the late 60s and 70s and yeah it sucks that Arafat and now Abbas have refused to take peace offers, but this sort of control is necessary because absent that control the Palestinians are a bit too keen to use any latitude to murder Israelis.

The debate has been on-going for more than a decade (maybe even two decades). The fallacious claim was made originally by the Hostile Arab Palestinians (HoAP) to incite hatred and provoke the emotions of outside observers.

Israel certainly has the right (and an obligation to its citizenry) to security is borders from the elements of the HoAP which present Jihadism, Aggravating Fedayeen Action, Hostile Insurgency Operations, Radicalized Islamic Behaviors, and other Asymmetric Violence.

Under the Oslo II Accords, the Palestinian Authority agreed that Area "C" would be under the full Israeli civil and security controls of the Israelis. This includes the construction and maintenance of the infrastructure necessary for these services remains in Israel’s hands. Civil matters remained under Israeli control.

Under International Law, Hague Regulations, Article 43. The authority of the legitimate power having actually passed into the hands of the occupant, the latter shall take all steps in his power to re-establish and insure, as far as possible, public order and safety, while respecting, unless absolutely prevented, the laws in force in the country.


The Gaza Strip is NOT under Occupation by Israel. Israel's plan of unilateral disengagement from the Gaza Strip was carried out on 15 August 2005.International Law, Hague Regulations, Article 42. Territory is considered occupied when it is actually placed under the authority of the hostile army.
The occupation applies only to the territory where such authority is established, and in a position to assert itself.
