A House panel voted to allow employers to require workers to undergo genetic testing or risk paying a penalty of thousands of dollars.


A little-noticed bill moving through Congress would allow companies to require employees to undergo genetic testing or risk paying a penalty of thousands of dollars, and would let employers see that genetic and other health information.

Giving employers such power is now prohibited by legislation including the 2008 genetic privacy and nondiscrimination law known as GINA. The new bill gets around that landmark law by stating explicitly that GINA and other protections do not apply when genetic tests are part of a "workplace wellness" program.

The bill, HR 1313, was approved by a House committee on Wednesday, with all 22 Republicans supporting it and all 17 Democrats opposed. It has been overshadowed by the debate over the House GOP proposal to repeal and replace the Affordable Care Act, but the genetic testing bill is expected to be folded into a second ACA-related measure containing a grab-bag of provisions that do not affect federal spending, as the main bill does.

"What this bill would do is completely take away the protections of existing laws," said Jennifer Mathis, director of policy and legal advocacy at the Bazelon Center for Mental Health Law, a civil rights group. In particular, privacy and other protections for genetic and health information in GINA and the 1990 Americans with Disabilities Act "would be pretty much eviscerated," she said.

HR 1313 doesn't look like it has anything to do with what you think it does and it was from 2 years ago.

This bill could put millions of people out of work and on government welfare....so how the hell does that create jobs?

All they're doing is creating unneccessary economic insecurity and more fear....but that is their plan, isn't it?

There was some pushback in coal country on Trumpcare. People don't understand bad policy until it affects them. Until their friends are going to lose their insurance and die from coal related illness due to the Republicans. That sounds like hyperbole but, it's true. If Republicans kick people off insurance and they have a serious condition they will die. That's how health care works.

There was some pushback in coal country on Trumpcare. People don't understand bad policy until it affects them. If Republicans kick people off insurance and they have a serious condition they will die. That's how health care works.

You have more faith in the typical Republican voter than I do.

I see it 1st hand. As long as the GOP hates Muslims and Mexicans and Gays many in the GOP base will still vote Republican, no matter how much the Republican Party ****s on their Health care and wallets.

Here's a link to the bill in it's entirety. The way I read it that it allows the use genetic tests as another way for companies to ascertain if an employee meets their "workplace wellness" standards and can receive the benefits of meeting those standards. Nothing about anyone paying any kind of penalty, just making it legal for this to be part of the normal tests that are carried out. It also specifically addresses GINA and explicitly states
shall be considered to be in compliance with—

(i) the acceptable examinations and inquiries set forth in section 102(d)(4)(B) of the Americans with Disabilities Act of 1990 (42 U.S.C. 12112(d)(4)(B));

(ii) section 2705(d) of the Public Health Service Act (42 U.S.C. 300gg–4(d)); and

(iii) section 202(b)(2) of the Genetic Information Nondiscrimination Act of 2008 (42 U.S.C. 2000ff–1(b)(2)).

Genetic testing is not cheap. I do not see a lot of employers really wanting to spend several hundred to thousands of dollars on it unless the employees worked in a high risk environment and they needed a defense in case the person got cancer to show they were predisposed to it.

I read the bill and your interpretation is naive and ignores the potential for abuse.

DNA testing before hiring...is sure way to create a new class of people ineligible for employment....as if having a police record wasn't enough.

To hell with what genetic testing suppose to do. If it is allowed we know damn well it will be ABUSED. No different then warrantless wiretaps, the Patriot Act, the NSA, and on and on.

It would be nice is just ONCE the so called 'smaller government, we want the government and big business out of our lives' Conservatives wouldn't be such big hypocrites and throw politics aside and tell the GOP to stuff this.

Because oftentimes, that isn't an achievement. It's just a damn accident.

Why should someone be punished for the possibility of developing, say, Parkinson's, 50 years from now? Especially since they could probably still work anyway if we just covered their damn healthcare.

Is America a meritocracy, or is it a eugenics-based plutocracy?

It's amazing what horrific government overreaches supposed "conservatives" will make excuses for if it's their guys overreaching.

Wellness testing? What does that mean exactly? That someone has potential for disease...and therefore is a liabilty and refused employment? It doesn't take a genius to see how easily that could be abused.

After someone has been refused employment because of their genes...how do they get a job?
