So your driving around this Texas city you don't know very well. Your 9mm glock is where you can reach it easily.

There's a demonstration up ahead and it looks like they're blocking the road. You speed up, the demonstrators dive out of the way...

But you hit a barrier and the car stops right in the middle of the demonstration.

While you're figuring out your next move, one of the demonstrators is approaching your car. He's carrying an AK47 in the "military patrol ready" position.


Do you shoot or do you not shoot?
 
You step out of the vehicle with your hands raised and open. You explain yourself and above all explain that you do not mean anybody, any harm (and apologize if someone was struck by your vehicle offering to transport them to where they might receive medical attention)

You explain where you're going and the protesters will let you pass or perhaps invite you to turn round and proceed directly out of the location. You do so calmly and in a manner not to cause and suspicion or distress.

First question

Why would I be so stupid as to drive into a protest? I like my cars and don’t want anything to happen to them.

Second question

If I was so stupid to drive into a protest, why on earth would I accelerate what can be seen as a deadly weapon towards the protesters? That would open myself to assault charges and potentially vehicular homicide charges

Now assuming I was stupid enough to drive into a protest and accelerate while doing so

Yes I would shoot, I committed acts of assault, attempted murder already, why not add shooting someone to the mix.

Then I would hope the police arrest my dumb backside and I get charged with a variety of criminal offences. Clearly someone who was as stupid as me should not be on the streets

Seems he may have been using the rifle for intimidation... wrong thing to do..especially
in Texas.
Sad situation but he chose to walk in harms way... it was his choice to approach the vehicle.

First of all avoid the area. If you see BLM signs, graffiti, white guys dressed in black, try to leave peacefully, call 911 and beg for help. Do an evidence narrative - beating on my car, pulling on door handles, jumping on car, saying they are going to kill you. If a window is broken to drag you out then in most jurisdictions you are good to go with deadly force.

The problem with shooting is getting shot at back.

Explain how a "low ready" hold on a rifle is threatening in any way.

So long as it stays in that position we are cool, the second it heads my direction we are on. Clue, bringing an AK style rifle to a protest is an extremely bad idea, and we both know it.

That's my thoughts as well.


I would say that if he didn't raise and aimed his rifle, and you shot him, it's murder. Maybe not first degree, but it's one of the lesser murders.

I said it as a condition to defend myself.

No, that is Your best plan for You, mine is to defend myself because I am not a Victim.
