If 2/3rds of house say to repeal the Second Amendment, then 2/3rds of Senate agree. Then 38 states agree to repeal the Second Amendment, the Second Amendment is gone. And gone through legal means, as written in our Constitution.
What happens?
To repeal an amendment, you need to pass another one (say a 28th amendment)
This new amendment would both repeal the 2nd amendment and grant Congress to power to pass laws, banning firearms
IMO, the simplest solution is for this amendment to ban ALL privately owned firearms, and then make allowance for the national executive to make exemptions
I would prefer to see all muzzle loaders, all bolt action and all shotgun (with a capacity of not more than 3) plus "classic" guns manufactured before 1946 exempted
Ammunition for non-exempted firearms is also banned
However I think it best not to invent convoluted legal definitions for these types but simply list all exempted firearms by make/model #
Then Congress passes a law banning firearms/ammunition in accordance with the above
I would include a 5-10 year penalty for being caught with an illegal firearm (ie: not on the list of make/model exempted) + a hefty (income based) fine to help with the costs on implementation
I would include a 5-10 year penalty for being caught with large quantities of illegal ammunition (say in excess of 100 rounds) + a hefty (income based) fine
I would include a 20-30 year penalty + fine for anybody caught making/importing illegal firearms/ammunition
I would institute regular amnesties for people to turn in their firearms/ammunition
I would grant law enforcement the power to search and seize based on "reasonable cause" (no warrant needed)
Reasonable cause to include (but not limited to):
Membership/patronage of a gun club/range
Patronage of a gun "training" organisation
Possession of a CCW
Purchases (including on-line purchases) on firearms/ammunition/accessories
Information passed from the public (including that passed anonymously)
I would give cash rewards for information leading to an arrest
I would commence a gun search/seizure on a state by state basis and allow 5-10 years to complete
All seized firearms/ammunition to be destroyed.
