    Colorado woman uses red flag law against officer who shot and killed her knife-wielding son

    FORT COLLINS, COLORADO- Iím trying so hard to stop laughing so I can tell you how stupid a Colorado woman is. I hate to speak ill of her since she has lost a child, but there really is no better word to describe her based on what sheís trying to do.
    Iíll compose myself now, but only because besides being entertained, Iím also a little frightened by her intent. And by the possibility of her intent becoming a reality.
    Let me back up. In 2017, Jeremy Holmes encountered 2 police officers, Colorado State University Police Corporal Phillip Morris and Fort Collins Police Services Officer Erin Mast.
    Holmes was holding a large hunting knife and telling the officers to shoot him. On the officerís body camera footage, viewers can hear Corporal Morris telling Holmes to put his knife down 36 times in 2 minutes.
    As Corporal Morris started to put his gun away (he later stated that he intended to use his taser to subdue the subject), Holmes charged at the Corporal with the knife unsheathed and raised.
    Corporal Morris and Officer Mast both fired at Holmes, which resulted in his death.

    Unfortunately, it was only a matter of time before people looked for ways to abuse "red flag" laws.

    I dont see this particular case going far, but you can bet there will be family members looking to use such laws with malicious intent; much like "swatting" to get the law enforcement and judiciary to do the dirty work for them.

    She lied on the report, claiming to be married to that officer. This won't go well for her.

    I haven't followed this too carefully, but I just saw on FB that one of my cop friends said her attempt was denied.

    Yeah, this ain't going nowhere...

    I'm not a fan of gun control measures generally, but I'll be interested to see how the red flag law works out. If used as I think it's intended, it could prevent the senseless shootings we see in the news every week, it seems, while protecting the gun rights of the vast majority of people. My sincere hope is that that's what it turns into--keeping guns out of the hands of people who will use them to do something crazy, while protecting the right of free non-crazy people to bear arms--a right that must be protected.

    One thing that worries me about the law is that a LEO can make the application. I think it should really require a family member if at all possible.

    the problem is that RF laws will be weaponized-in nasty custody or divorce cases mainly by women against their husbands or ex husbands. That is why there needs to be mandatory felony jail time for anyone who misuses these laws.

    you have heard of the crime called "swatting"? One instance led to an innocent person killed by the cops. The person who instigated that death got 20 years in federal prison-which I believe was about right. But others involved also got prison time as well.

    Casey Viner, who solicited a 'swatting' call that led to a death, gets 15 months in prison - CNN

    The reports I've seen claimed that she said she was married to the cop, because only family and roommates can ask for a red flag order; that she claimed to have a child with him, and that the cop had been making threats against them.

    Completely bogus top to bottom. She needs to be punished for filing a false report imo.

    felony perjury, obstruction of justice and a few other offenses if she used a phone or computer
