A man in Florida fought back against a home intruder and ended up injuring his face in the scuffle, a report said.
The man, identified as Barry Sands, was sleeping in his Miami home soon after 10 p.m. when he woke up and heard a woman screaming and asking for help, Fox News reported.
Sands opened the front door and was allegedly attacked by Mark Katsnelson, according to the report.
Sands fought back, pummeling Katsnelson a number of times with his fists, Fox reported.
Katsnelson, who suffered facial injuries in the melee, was transported to a hospital after the beating.

In Constitutional Carry Oklahoma.....

TULSA, Oklahoma - Tulsa Police released new details on a fatal shooting last week. Authorities said the man who shot Alfred Guy did so in self-defense after Guy stabbed him.
TPD said Alfred Guy, who was high on PCP, went over to a friend's apartment to ask for a ride. When the friend said no, police said Guy attacked his friend.

See ?

Gun owners pay attention, no gun needed !!!

Excuse 2.2 is further de-bunked.

Way to ignore the other two articles that prove your debunked claim is utter nonsense and how having a gun was beneficial in stopping a criminal. You’ve debunked your debunking claims yet again

This is a good example of what I'm talking about

NO GUN NEEDED FOR HOME DEFENSE

that's like saying surgery is the only proper therapy for cancer.

It's one of the basic ways.

This incident showed that you don't need a gun to defend your house.

not always but a wise man is prepared for many different problems. A fool is not

Surely ALL Americans who don't own a gun are "fools" in your thinking.

not at all, those who are terrified about owning guns and might hurt themselves should not own one.

So they are "defenseless"

What about people who are not terrified of guns but chose not to have one - they are fools according to you?

I don't pretend to know their situation. They might live in a guarded facility. I believe in choice-you do not

Nevertheless you felt able to call them "fools" for not being prepared like a wise man

So a man (or one supposes a woman) not prepared for an armed home invasion is a "fool" according to you ?

Libtard gun owner says: Great job!

Yes it is.

As someone with a proclaimed 30 years in prosecution you should know that.

Lethal force cannot be applied to a person fleeing.

you're lying.

No, you are - if indeed you have 30 years of prosecution experience

Otherwise you're just plain wrong.

Clearly you don't know the difference.

lets talk about de jure and de facto situations

you come home and find some mope has killed say your three children and is raping your wife. You get your gun (LOL) and engage in a gun fight. he flees and you shoot him in the back

De facto-what are the chances you will get charged

de jure -can you make an argument that he might be trying to get more ammo or a cover to shoot back? or that he would rape and kill others if he got away?

No, lets talk legality

When I told you lethal force is not justified (legally) against someone running away you said:

"that's not always true"

and when challenged you said:

"you're lying"

Now after an internet search you claim you're right because a sympathetic court might acquit you ?

Question: Are you STILL saying lethal force is sometimes legally justified on a person RUNNING AWAY ?

Again, further evidence that you were never a lawyer nor did you ever have 30 years experience in prosecution.

I didn't do a google search. Having shot someone years ago, I became an expert on use of force. It is why I defended police officers in private practice and federal agents as a DOJ attorney in this area. I cannot help it if your only defense is to lie about my background.

Answer the question-in the scenario I laid out, will you be charged?

You don't need any help for that

The statement was that it is never legally permissible to shoot someone who is running away.

You said "that's not always true"

and when challenged you said:

"you're lying"

You seem to throw that accusation around a lot.

Now Mr lawyer with 30 years experience, when does the law say you can use lethal force on someone running away ?

You can't use lethal force to stop someone running away.

There is no set standard that I've seen. Some states seem to allow such force to be used while others restrict such actions. It appears that it is determined on a case by case situation.
