Define assault weapon

And you have presented NOTHING.

You made baseless claims you can’t support. If there was an onus to present something, that would be on you. Your ignorance is your own responsibility not mine.

What claim of fact have I made that was not supported?

You claim that the militia does indeed exist but you can offer no verifiable evidence that it does. I have asked several times for a schedule of meetings and nobody can present one.

Fine. Quote the language in the Constitution which says this.

You are correct. There is no language in the Constitution that allows the government to usurp the Bill of Rights just because the government believes it has a compelling interest. Nor is there language in the Constitution which grants SCOTUS the authority to establish such a standard.

There is no language in the Constitution stating this idea of a compelling government interest - something your side repeatedly has used as the crux of your argument.

That’s what I just said. [emoji2359]

As a non-affiliated voter, I don’t have a side. [emoji2369]

Just because your opposition used an excuse is no moral justification for you to use the same excuse. Logic 101.

Still awaiting the schedule of militia meetings that I have been lax in attending for the last 70 years.

One would think that if there is a functioning militia, one should be able to point to a schedule of meetings and sanctioned activities for its citizens who are supposed to be members. Where exactly is that?

Well I don't know which state you are a resident of, but here in Virginia, "The militia of the Commonwealth of Virginia shall consist of all able-bodied citizens of this Commonwealth and all other able-bodied persons resident in this Commonwealth who have declared their intention to become citizens of the United States, who are at least sixteen years of age and, except as hereinafter provided, not more than fifty-five years of age. The militia shall be divided into four classes, the Virginia National Guard, which includes the Virginia Army National Guard and the Virginia Air National Guard, the Virginia State Defense Force, the naval militia, and the unorganized militia."

There is not currently any have militia, but for the other three: Virginia National Guard | The Commonwealth's Guardian
There are no meetings for the unorganized militia.

So you agree that the argument about a compelling interest is something not taken from the Constitution.

Because there is no militia in reality. Words on very old paper have long ago gone with the wind.

Perhaps my typo confused you: I meant to say "there is not currently any naval militia." The Virginia Army National Guard, Air National Guard and Virginia Defense Force are all very real and do have meetings. By definition, unorganized militia can't have meetings, otherwise they'd be organized. The VDF is closest to what you are thinking of.....unpaid volunteers, few and lax physical requirements, uniformed while serving, liable for call-up by the governor (In which case they are paid. )

Of course the National Guard is real and has real meetings. They are part of what replaced the historical militia.

And the Virginia Defense Force is a continuation of the historical militia. Other states have similar militia.

Let's start with the state of Oregon. Your previous conversation with someone else?

Chapter 396

As I have stated, the citizens militia of the Second Amendment has been replaced with formal organizations. Thank you for the information supporting this.

And the Virginia Defense Force is a continuation of the historical militia. Other states have similar militia.

This from the opening page of the website of the Virginia Defense Force

About the VDF:
The Virginia Defense Force is authorized by the Code of the Virginia as the all-volunteer reserve of the Virginia National Guard and serves as a force multiplier integrated into all Guard domestic operations.

Virginia Defense Force – Virginians Helping Virginians

As I have stated, the historical militia has long ago been replaced by formal organizations who handle defense and policing. This is merely one example.

10 U.S. Code § 246 - Militia: composition and classes

(a) The militia of the United States consists of all able-bodied males at least 17 years of age and, except as provided in section 313 of title 32, under 45 years of age who are, or who have made a declaration of intention to become, citizens of the United States and of female citizens of the United States who are members of the National Guard.

(b) The classes of the militia are—
(1) the organized militia, which consists of the National Guard and the Naval Militia; and
(2) the unorganized militia, which consists of the members of the militia who are not members of the National Guard or the Naval Militia.

(Aug. 10, 1956, ch. 1041, 70A Stat. 14, § 311; Pub. L. 85–861, § 1(7), Sept. 2, 1958, 72 Stat. 1439; Pub. L. 103–160, div. A, title V, § 524(a), Nov. 30, 1993, 107 Stat. 1656; renumbered § 246, Pub. L. 114–328, div. A, title XII, § 1241(a)(2), Dec. 23, 2016, 130 Stat. 2497.)

There are also active State Naval Militias in Alaska, California, New York, Ohio, South Carolina, and Texas. More States have Naval Militias, including Virginia, but they are not currently active. The National Guard is not part of a State Militia, they are, as the name states, national and part of the Department of Defense and therefore part of the organized national militia. Virginia's State Defense Force is part of the organized State Militia. There are 28 States with an active State militia.

The National Guard is the organized militia. What evidence do you have it replaced the unorganized militia?

Show me the evidence that it exists.

Hey HayMarket

If you're an able body American that will defend you're already in the militia(wink)

The National Guard is the national organized militia, which has absolutely nothing to do with the organized or unorganized State militias.
