Perhaps so, perhaps not. Being a gang member does not necessarily mean being a felon. As for people with a history of illicit drug use, are they barred from having guns in the rest of the country? If so, that would be a sizable percentage of the general population.
If you're currently using, yes you can be prosecuted.
even if a gang member doesn't have a felony history there is other ways you can get guns from them. if they're on bail, if they're on probation, if they've indicted for a crime, if they were stopped for a traffic offense and an officer found evidence of drugs, if they were frisked and had a gun but not a license, they can have a firearm seized.
