States With Legal Marijuana-Don't Admit To Smoking-Lose Gun Purchase Right-ATF

That's a loooong list. My wife bought me a half case of Angry Orchard hard ciders about two months ago. Last night I used one bottle to make bacon/apple risotto (freaking incredibly delicious!!!) and there's still 5 bottles left.

the same fraudulent expansion of the commerce clause that "allows" the ATF to even exist is the same fraud that "allows" the federal government to criminalize weed even if its grown in Colorado and only used in colorado/ Maybe one day, dopers and shooters will realize its time to return the commerce clause to what it was intended to be-that is-an empowerment of the Federal government to prevent one state from preventing commerce by another. NOT ANY AUTHORITY OVER private individuals acting in their own sovereign states.

Here's an absurd situation that US laws have created, brace yourselves for this one folks cause this about to get heavy.

Next year Canada will likely legalize marijuana at the Federal level for recreational use.

Washington State has legal Marijuana for recreational use as an example.

If I were, as a Canadian to drive from Vancouver to Seattle and admit to a an American Federal Border Agent that I've used marijuana ever, in my entire life, I can be banned from entering the US for life even though it would be fully legal in the Country I was leaving and the state I was entering.

that's why we need to severely restrict the commerce clause expansions

the federal government was never intended to have this sort of power
 
I read in the latest Bloomberg Businessweek issue the ATF will go after you if you claim you smoked dope even if you live where it is legal. Anyone have any info on this?

Here is what is going on in Colorado for the people that have medical marijuana cards:
U.S. court upholds ban on gun sales to marijuana card holders – The Denver Post

If a person checks the box that they have used pot they won't get a gun. If they are caught with pot and a gun they are in violation of federal law. Pot is still illegal as far as the feds are concerned. We can only hope that this will change pretty soon.

That isn't the definition of "alcoholic". I don't think you know what "alcoholic" means.
 
Actually the question is asked " Are you an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance?" If you are in a state where Marijuana is legal the lawful answer is 'no'

Not if they can use it to trump up charges, or as an excuse for contact with citizens, or their favorite, an excuse to steal property. Government doesn't really like giving up power.
 
Then you are committing a crime by lying on a federal form.

Oh well. If the government is going to be completely dishonest with their "study" of marijuana, I'll support folks giving back that same honesty on the forms.

Personally I would trust a someone stoned with a gun over a drunk any day.

I don't condone using firearms when drunk or stoned, but I would typically trust being around someone stoned than someone who is drunk. When is the last time you saw a major brawl started by a stoned person? I know I have never seen one. But I have seen plenty of brawls started by drunk folks.

I hope Congress votes to decriminalize pot. Either they do that or face an argument about states rights that would have an influence on gun rights arguments that they want to avoid. What I would like personally is to force an issue in the SCOTUS for state's rights.

It's a Republican majority Congress. I wouldn't count on them legalizing the demon weed.

Then it can be settled in SCOTUS (my preference), unless the new AG just lets states slide and the current situation become status quo. That would suck. I actually think there is a enough people that think the law is stupid to get it changed.

I wouldn't put a lot of faith in a branch of the Federal government coming down to transfer power from the Fed to the States. But this absolutely is a State's rights issue.

I don't either. The only way states get power back from the federal govt is if the SCOTUS forces it. The best way for the feds to keep power is to reclassify pot which is why I hope they don't.

I think it's more "can go", rather than "will go". In 2010, 76k 4473 denials were referred from FBI to ATF. ATF sent 4k names to the field for further investigation, even though that list contained the names of 34k felons. I don't think they'd have the manpower or White House mandate to chase down weed smoking gun owners.

Then again, it is a sort of move to separate freaks from guns, so we gotta start some place. The weed thing won't last long though, they're diving at the bottom of the barrel on that one.

hmmm.. actually as the question is currently defined.. if you are using marijuana.. then the answer you should give is yes.. to be consistent. Marijuana is federal illegal.
