WASHINGTON — In the spring of 2014, a friend tried to nudge Judge Stephen Reinhardt, then an 83-year-old liberal stalwart on the United States Court of Appeals for the Ninth Circuit, into stepping aside from full-time duties so President Barack Obama could nominate a successor.

The friend, Erwin Chemerinsky, now the dean at the University of California, Berkeley, School of Law, said he had gently suggested to Judge Reinhardt that he and another longtime liberal figure on the San Francisco-based court make way while Democrats still had the power to assure that jurists with a similar philosophy would take their place. Judge Reinhardt swiftly rejected that notion and stayed on.

Now Judge Reinhardt, who died this past week at age 87, could very well be replaced by a nominee chosen by President Trump. The president suddenly has a chance to seat a judge with a markedly different judicial outlook, giving conservatives a greater voice on the liberal-leaning court, which has been a particular thorn in Mr. Trump’s side.

Now, that said (and I meant it), let me say I couldn’t disagree more with anyone’s judicial philosophy or interpretation of the Constitution than I did with Judge Reinhardt. Even if I agreed with a ruling, I would disagree vehemently with his reasoning for the ruling in that no single man could take plain English in the Constitution and reinterpret it to mean the exact opposite of what a plain textual reading would mean.

Now to the thread topic. Who else thinks that the Democrats are rethinking the wisdom of allowing Harry Reid to destroy the filibuster for Presidential appointments, especially to the federal bench? What impact will Trump and McConnell have long term on the federal courts?

Those days, never really existed. However, the political bent of a particular jurist has taken on a more prominent role in the public debate surrounding their appointment. That role has always existed, it just wasn’t as widely or openly discussed as it is now.
 
I'll be happy if Trump appoints someone who won't legislate from the bench...for either side.
 
What does that mean?

The Clinton Body Count was a CT about the Clintons killing people. This seems a good spot to fire that CT up for the new President. Perhaps traces of Russian radioactive elements would be found if an autopsy was performed...

It’s not as funny if you have to explain it. But, it’s still pretty funny. I caught it as soon as I read it, and literally laughed out loud and put my head in my hands thinking, hear we go...

Course that is extremely subjective... when a ruling goes against the rabid right they tend to shriek about unelected lawyers in robes. Legislating from the bench. Defying the will of the people...etc....

Rule the way they like and they applaud the result... ;)

Now it is a tricky business getting a Supreme Court Justice to do as you wish. Chief Justice Roberts 'turned' on his right wing supporters by permitting major portions of the ACA to roll forward... :shock:

I find it quite a strange scenario- the rabid right will hold their noses to get a supreme court justice that may or may not rule the way they wish and vote for as amoral a man as Donald grab them by the ***** Trump to try and bend the highest court their way.

Interesting value system... :peace

You know...we are talking about the Ninth Circus...not the Supremes.

The 9th has a long history of legislating from the bench. THAT'S what I don't want.

It’s high time for some competence to be installed in the 9th Circus court.

As a matter of face we need another district court. Their territory is too big, so as well as having too big of a caseload, they are also over burdened with California’s bull****.
 
As of April 6, 2018, the United States Senate has confirmed 29 Article III judges nominated by President Trump, including 1 Associate Justice of the Supreme Court of the United States, 14 judges for the United States Courts of Appeals, 14 judges for the United States District Courts, and 0 judges for the United States Court of International Trade.[2] There are currently 55 nominations to Article III courts awaiting Senate action.
