Fox's Napolitano to Trump: First Amendment 'does not regulate Twitter'

Fox's Napolitano to Trump: First Amendment 'does not regulate Twitter' | TheHill

Fox News legal analyst Andrew Napolitano said Wednesday that President Trump faces an uphill battle with his threat to regulate social media platforms like Twitter.

“The First Amendment, which guarantees the freedom of speech and of the press since it only regulates the government, does not regulate Twitter," the former New Jersey Superior Court judge said on "America's Newsroom."

"Twitter can take down, modify or correct any user it wants, including the president of the United States," Napolitano added.

Trump should read the Constitution.

Napolitano is correct. It’s amazing how elected officials forget that there are indeed limits to their power.

Democrats are treating Biden like Republicans treat Trump. His gaffes, mistakes, and moments where he's in the wrong simply don't matter to them. It's not changing anything when he makes offensive remarks about the black vote, or gets caught lying about something.

Just as nothing seems to effect Trump's numbers, nothing seems to effect Biden's. The debates, assuming they happen, will have no effect on the outcome. Trump may not even show-up to them, and if he does let's not forget that his mental state is so bad that you can be guaranteed he'll sound like he's on crack.

Trump is going to lose and will be a complete spectacle.
Those are strong, powerful, unequivocal words. But you've been right often, even as I've been more moderate. So, I surely won't bet against you.

I do very much agree if Trump loses, it is going to be a spectacle that will make our current embarrassments pale. There's a subset of his supporters that are going to seriously crack-up. They won't be able to handle it, won't be able to comprehend the reality of what's occurring around them. "One term & out though", would ratify that Trump was an error, a mistake best forgotten, and policies best repudiated.

Trump is so mentally deranged, he would seriously still believe he won.

I've come to believe that the Trump era ends with his security clearance being revoked, and the SS having to remove him from the WH. He will force it to come to that.

At that point, who cares? Just another sad Trumpian entry into the annals of history.

The big question is, what will the RNC & Republican politicos do? Will they stick with a loser & a losing path? Will their voters allow them to right the ship? God, it's going to be a hot mess!

You're not going to have to worry about said "spectacle" because Grandpa, even with the amount of cheating the Dems plan, is not capable of going the distance. If you guys had somebody in their right mind and policy ideas that didn't sound like they were out of the 1930's Soviet Union, you'd have a chance. But, alas, you do not.

i so hope that Twitter bans him. should have happened years ago.
I get your point, but I’d rather that every time trump posts lies, Twitter flags them. It would probably take a full time (24/7) dedicated team to keep up, but boy it would be fun to watch! ;)

Yes. I need to constantly remind myself that those remaining in the Republican party are mostly Q-anon, turning the frogs gay, Obama born in Kenya, Clinton body count **** for brains morons that have slowly lost the ability to think for themselves. It's terribly sad.

It is pretty funny if Twitter is flagging his bull**** lies as bull****. However, I won't be checking until they ban him.

I feel Trump will win and the cult members will still riot.

I don't look forward to this winter.

The problem is that Trump is collapsing mentally. It's what happens to a lot of dictators/fascists when they feel they're losing control over their fate. I don't know if you've seen Narcos, but the show depicts Pablo Escobar's fall, and it shows how he sort of lived in his own imagination as his personality cult collapsed. It's one of the final stages.

The final stage in a fascists fall is that when lose a democratic election, they fight to not leave. This is almost certain to happen with Trump in the event that he loses. He'll insist that he didn't really lose the election, and that he actually won, and then he's staying. He will be in complete denial, making plans for his new EO's, and it's 50/50 he'll sit at the oval office as Biden walks in.

How will Republicans react to it? There will be a mix of support and those who realize "it's over!", with some encouraging riots along with him, and others who are done with him agreeing that he needs to peacefully leave - which will be more about the damage to the party.

Considering his entire presidency has been a reality TV show, that would be one hell of a fitting ending.

You won’t have to. Trumpsters will post defenses each time Trump gets dinged. ;)

Colour me niave perhaps, but I don't expect the bulk of the Republican politicos to encourage rioting, if Trump loses the election.

Banning him from Twitter would have strategic political ramifications. If he can't Tweet, he loses a great deal of his influential power. He requires Twitter to be fully politically active.

I get that too. Look at the other side of the coin now.

Trump has fewer Twitter followers than other famous people including Ellen DeGeneres, Taylor Swift, Lady Gaga, Rihanna, and the most followed person, former President Obama. If twitter starts dinging Trump every time he lies, that will get the attention of far, far more folks that aren’t Trump supporters, and may influence them against Trump.

Bottom line, Keeping Trump on twitter has a better chance of hurting him than helping him, IMO.

The crazies like Jordan in the House absolutely will. You can count on it. Talk radio and some FOX hosts will, too.

What percentage won't? Hard to say, but Ryan, Cruz and Graham will throw Trump overboard once he's a loser. They won't care how many voters still love him. If he's loses and costs them the Senate, he's of no use to them any longer going forward.

The party will be rumble when Trump's done with it.
