Oakland is the first California city to ban criminal background checks on renters - CNN

From the land of fruits and nuts:

The ordinance, passed by a unanimous vote Tuesday, means landlords are prohibited from requiring applicants to disclose their criminal histories. They would face fines of up to $1,000 for each violation.

Unbelievable.

Proponents of the measure, called the Fair Chance Housing Ordinance, hope it'll tackle several problems at once. They believe it'll give formerly incarcerated folks a fair shot at a place to live, reduce the chances they end up back in prison by providing stable housing, and reduce the wider issue of homelessness, which jumped 16.4% in the state in 2019.

Note that two of these problems have been caused directly by government - mass incarceration due to the democratic drug war, and all of the government zoning and regulation in California which prevents new housing units from being built. The lesson, as always, is that the problems caused by government intervention into the economy will always be met with even more government intervention into the economy.

This idiotic ordinance passed by idiotic leftists is similar to the "ban the box" law, which prohibited employers from asking about your criminal record on job applications.
That law resulted in an increase of racial discrimination.

Are leftists incapable of learning from their past mistakes? Or perhaps they do learn, but pass laws like this knowing it will make things worse? They're either stupid or evil, take your pick.

Criminals. The new protected class.

Imagine being a landlord and unbeknownst to you your swinging jail door drug dealer deals out of you rental, and the state seizes it under forfeiture laws.

This is all part of why Soros has been so interested in local district attorney races.

Also known as: how to make rental properties worthless with the stroke of a pen. :lamo

I'm split on this. On one hand I think home owners have the right to know if the criminally-inclined will be living in their place.

Buuuuuut....I also suspect that criminal background checks can lead to recidivism.

I disagree with this. Landlords do have a right to know who they are renting to, and that includes criminal history.

On a more basic level though, we need to figure out a better way to handle former criminals that doesn't just lead to them engaging in an endless cycle. We like to pay lip service to the idea of people serving their time, but in reality it can end up as a scarlet letter for the rest of your life. We strip voting rights and many employers won't take a second look at a felon. That just makes it harder to integrate back into society.

Years ago, I could have rented a home to a smooth talking shyster with six judgments against him if it weren't for a background check being on my side.
This state... Hopefully, the idiocy of Oakland remains isolated.

To play devil's advocate, where are people with a criminal record supposed to live?

A nearby city of Richmond pays gang members a $1000/month stipend to NOT commit crimes!

Spreading some wealth to criminals - - that's how we roll in California.

Are right whingers ever able to make a point without sounding like low-functioning teen-agers? Damn. Something happened last summer. It's like all the other discussion boards on the internet suddenly adopted intelligence requirements and we were inundated by rightards here.

Anything that makes landlords upset are okay with me. They should be happy we are not currently voting on whether or not they should get the wall.

Being forced to live in gang and drug infested neighborhoods is not really a second chance.

So you didn't ask for references?

We hired a service to do a background check.

But that was not the only way to accomplish your goal. You could have hired a service to check references and accomplished the same. Your anecdote is incomplete and self serving.

I bet the same people that complain about recidivism rates oppose this measure. Hypocrites.

You didn't need the criminal background check, if you or this company you hired just asked for references you would have gotten the exact same conclusion without potentially turning away a reformed former criminal.

They did all that....

Have you ever owned rental income homes? I bet not.
One thing I'm not is a hypocrite. Landlords have the right to protect that assets which is precisely why that particular white collar criminal failed the test.

"Background checks saved me, boys, don't let them take my safety away!"

Pathetic.

Keep guessing.
You haven't a clue.
We don't rent to deadbeats who fail to pay their bills and have judgments against them. Running a credit check on potential applicants is legal in the state of CA. References wouldn't have told us what we needed to know from a credit check.

Anecdotal victim status... Gee, where have I heard that before?

So I could check the sex offender registry and the local court case index online and get a pretty good feel without having to force them to provide it. While there, I can also look on the civil side and see if they have any history of being sued or evicted.

This thread is about criminal background checks not credit checks.

Landlords only deserve the bullet.

I don't see a problem with this.

As for jobs, there isn't a problem with some jobs requiring a background check. But it will be part of the information given to potential employees that if they are selected, final qualifications can be determined by a background check.

Can you show us how that has already happened under current law?
