This lady looked me up and down the other day... I felt so violated that I reported her to the police. It was inappropriate and a form of sexual assault. You are correct. It is not enough to call it inappropriate and that is why we are looking into a lawsuit and the police might charge her.

The law was written that way to discourage unwanted touching, which is exactly what battery is. If we aren't going to prosecute people for violating it, what is the point of having the law at all?

Battery, almost universally, includes physical contact that causes harm. A slap on the butt does not cause actual harm.

Uhhh.... nope. I don't think that anybody should slap another person on the butt unless you know them or are on the same team, etc. I am not defending what the guy did. I am saying that it is not sexual contact nor is it battery. I am also not enabling anything. Not attacking people who think it is not a big deal is not enabling, at least to anybody that really knows what that term means.

Intent is a big part of most of these incidents. If his intent was to be funny (not at her expense) or to give a sporting "lets go!" kind of moment then he was not offensive. She (people) can be defensive though, without a person actually doing something wrong. People can be offended at all sorts of stupid stuff that was not intended to be offensive... that merely makes them defensive.

Most battery laws that I have seen include "offensive" or "insulting" physical contact in their definition. I can only conclude that this was done intentionally to cover incidents just such as this.

I have been seeing that as well, as I look more definitions up. This would fit neither of those, to most people applying common sense (not you... a jury, judge, etc.... well, and you, me, etc.)... those terms were included for incidents like holding a person against their will, hugging a person not wanting it, grabbing an arm, restraining... etc. This incident would not apply to either offensive or insulting if that was not the intent.

You're a foreigner and don't have a clue about civilized behavior toward women. That's your problem, not mine. If you want to measure copping a feel on a woman and committing simple battery on her by the number of seconds involved, that too isn't my problem.
