Impeachment question.

I'm using the term impeachment to cover both the house and the senate parts.

If the house impeaches and it moves to the senate do the folks who defied a congressional subpoena then have to testify if called?

In my opinion, and I am sure it will be the opinion of the courts, is that they did have to appear before Congress. They are subject to charges and jail time. And they will also have to appear before the Senate.

I do not recall anytime a court saying the subpoena issued by armpit, flyover_state had more power than one issued by the House of Representatives.

They would have to testify if called. The Senate portion is conducted like a trial and is presided over the the Supreme Court Chief Justice.

But keep in mind...

1. There will be no biased people presiding over the event like there is in these House farces.

2. There will be no leaked testimony that supports a narrative like there is in these House farces.

3. Both the prosecutor and the defendant will be able to subpoena testimony without the other vetoing it like there is in these House farces.

4. And lastly, it is the Senate body that is the jury. They will determine guilt or innocence. Not the public.

Be careful what you wish for, because Hunter and Joe Biden might get subpoenaed, along with the whistleblower (if he exists). Not only that, the people who refused to appear before the House might not tell the story you want them too. In fact, their testimony might result in some of your swamp tour heroes going to prison.
 
When the impeachment process goes to the Senate for trial the Democrats will have to take off their clown noses and clown shoes and act like adults. It's going to be a whole different stage.
 
If 20 years of Law & Order has taught me anything it's that you don't call witnesses without knowing the content of their testimony.

Calling someone into a trial that refused to take part in the investigation would be a crap shoot. I have no prediction.

While it has been much reported, I don't think anyone has defied a legitimate subpoena yet. Something called a subpoena has been issued to a number of people that could not be compelled, which means the name is a fiction.

I'm looking forward to all the president's men having the opportunity to testify under oath. The public does and will pressure the gop senators to act according to the facts. If they don't, the voters have the next say come election time.

Congress has often voted contempt of Congress when there is no legal grounds. It looks good on CNN or where ever.

I never said there was nothing. I said that many things have been called subpoenas that were not. That does not imply that Congress cannot subpoena, just that there are limits and Congress often reaches past them.

There is no greater mechanism for compelling White House employees to testify than already exists in the House. And anybody who disagrees is free to share with us that mechanism.

And they will not share that mechanism with the rest of the class because they know it doesn't exist.

Yip that is when Republicans, put them on and assume the position of the three see no evil, hear no evil, speak no evil monkeys...

It will be a true test of Republican integrity...
