Legally that is true. Common sense would say otherwise.
When picking a president, common sense is much more important than legally. We want a moral person as the head of our country, not a thief that has not been convicted. Don't you agree?
I agree that common sense isn't all that common.
It's true that very often where there's smoke, there's fire--hence, the saying. But because there is smoke, we don't decide without proof that there is fire.
