Supreme Court hands Virginia Democrats a win in gerrymandering case

The Supreme Court’s action let stand a 2018 ruling by a federal three-judge panel that the 11 districts all violated the rights of black voters to equal protection under the law under the U.S. Constitution’s 14th Amendment.

The Supreme Court has ruled against the Virginia House of Delegates in a racial gerrymandering case that represents a victory for Democrats in the state. In the 5-4 ruling, the justices found that the House didn't have the standing to appeal a lower court ruling that found that the new district maps must be used ahead of statewide elections later this year. Those new maps are already in use. Democrats had claimed that previous districts were unlawful because they featured too many black voters, diminishing their power across the state and in other districts.

Democrats had claimed that previous districts were unlawful because they featured too many black voters, diminishing their power across the state and in other districts. Virginia House Democrats celebrated the ruling in a statement Monday, calling it "a major win for voting rights and civil rights in our Commonwealth.” "House Republicans have spent millions of taxpayer dollars defending racial gerrymandering in a protracted legal battle - a battle in which they lacked legal standing," House Democratic Leader Eileen Filler-Corn and Caucus Chairwoman Charniele Herring said in a joint statement. "Finally, Virginians in the affected districts have the assurance that they will vote in constitutional districts in this year’s election."

I'll always applaud when partisan gerrymandering suffers a defeat. Far too often it's purpose is clearly to disenfranchise a particular voting bloc/demographic in order to maintain political control.

Racist attacks from the party that has employed the Southern Strategy for over 1/2 a century. So no surprise. Good on the courts for stopping it.

Good. Every little bit helps, when fighting the GOP/Trump war on democracy.

The 15th Amendment is very clear that voting rights must not be abridge for racist reasons.

This ruling is a small step to help protect those rights.

I'd like to comment on a matter here though, that speaks to the damage Trump is doing. Remember, this was a 5-4 decision; it was only one Trump appointment away from the opposite ruling. Remember this, when you pull the curtain closed next November.

Did you even read the article?

Justice Ruth Bader Ginsburg wrote the majority opinion and was joined by Justices Clarence Thomas, Sonia Sotomayor, Elena Kagan and Neil Gorsuch.

Justices Samuel Alito, John Roberts, Stephen Breyer and Brett Kavanaugh dissented.

Neil Gorsuch was a trump appointeed. He joined the majority.

He did this time, sure. But, one more "Kavanballs" appointee and this is overturned.

Gerrymandering is a massive problem, thankfully this time the Repubs got smacked.

Irrespective, they were only 1 vote away. That's a good reason to not let Trump further shape the Court.

It was trump's appointment who made this a majority.

No one can predict what a given Judge will ever do. But at only one more vote needed here, it's too dangerous to give Trump another. Voters need to see concrete examples of what can happen, as it almost happened here.

If trump didn't appoint Gorsuch to replace Scalia, this would have been a 4-4 decision.

You can't predict that. But I surely wouldn't give Trump another shot, here.

Except, I can, because you take out Neil Gorsuch, a trump appointee, and it would have been 4-4.

Why no anger against Stephen Breyer, a liberal justice appointed by clinton, who dissented?

No you can't predict a Judge's vote! This has nothing to do with anything. It's a 5-4 decision. It's 1 vote away from reversal.

We cannot absolutely predict the way a given Judge will vote in a given instance, but we know here it was only one appointee away from reversal. I have no idea what you're trying to prove here with you hypothetical logic, when the math is unequivocal.

That is why we must vote Democratic. Even if our nominee is Biden.

Absolutely!

Then let these guys remain in their own little corner of the universe, pretzel-logic-ing each-other to insanity. Letting this type of stuff become mainstream and accepted, may be perhaps the worst aspect of the Trump Presidency. It's getting beyond ridiculous, and I can't wait for it to come to end.

There are 3 critical "missions" come 3 November 2020.

Defeat Trump, flip the Senate, and maintain the House majority.

Mitch McTurtle is the Congressional force that is protecting Donald Trump.

Don't take anything for granted. Vote.

McConnel is a heavy lift. But Trump is definitely doable, with the right candidate.

They already voted, therefore, there is nothing to predict. 5 justices voted one way. You take one of them away, and then you have only one 4 justices voting one way. 5 - 1 = 4. It's that simple. You went to grade school, they taught you math. Use it.

Are you predicting a judge's vote? How do you know a future appointee would reverse a decision? How can you predict that? Hmmm....

A conservative SCOTUS judge is going to vote from a conservative understanding of the law the majority of the time.

This is why Trump nominates conservative judges vetted by the Federalist Society. This isn't rocket science.

It will be all hands on deck Nov 2020, take nothing for granted. Turnout will be key as it was in the 2018 mid terms.

McConnel is a heavy lift.

McConnell will probably win reelection, but the GOP majority has to go.

Nothing is impossible until we believe that it is.
