Justices Let Alabama Execute Death Row Inmate Who Wanted Imam By His Side

Death Row inmate Domineque Ray hoped that when he took his final breath, he could find comfort in the presence of his Muslim spiritual adviser. But the Alabama prison where Ray was awaiting execution wouldn't allow it. Prison officials would only allow their own Christian chaplain to offer the prisoner solace from inside the execution chamber.

Ray challenged that decision, and a federal appeals court on Wednesday granted a stay of execution until it could determine whether the prison had violated the Establishment Clause of the First Amendment by preferring one religion over another.

But the next day, by a vote of 5-4, the U.S. Supreme Court allowed the execution to go forward.

I guess that's one way to ensure more Christians get to heaven. :roll:

Wonder if Tiffany had a choice to ask for a pastor while Ray raped and killed her? He got exactly what he deserved!!


Ray was sent to death row in 1999 after being convicted of murdering 15-year-old Tiffany Harville during the course of a rape and a robbery. Tiffany and her mother lived in Selma, and her mother left home one night for a work event. When she returned home the next day, no one had seen Tiffany and the teen’s mother reported her missing.

Yes, we know that if somebody is being put to death then the crimes he committed are probably going to be pretty awful. However, he's not going to commit any more crimes since he's about to be dead. Letting somebody with the right funny hat give him his last rites won't mess up your day.

There is nothing in the Bill of Rights that entitles anyone to have a priest of their choice present during their execution.

The majority did not rule on that ground, however, but on its finding that the appellant was too late in his filing.

Are Christians who are not employed by the prison allowed in the execution chamber? My take was the prison only allows authorized staff inside the execution chamber, a smart policy.

The question wasnt whether or not you are entitled to have a priest at your execution, you have no such right. The question was whether or not a state run institution could offer such a service to one religion and not another. Chances are that might violate either the 1st or 14th Amendment. Chances are the practice will just come to an end rather than keep a stable of religious personnel on staff to accommodate any absurd demand by the condemned.

That's fascinating. Even the Supreme Court site lists only the dissent and not the majority opinion.

Keep in mind that the stay was vacated not because Muslims aren't allowed in the death chamber but because Ray waited until the last minute for his request and the state has a requirement to train anyone allowed inside the death chamber.

This decision has NOTHING to do with the Constitution and everything to do with whether states are allowed to have their own rules (which do not violate the Constitution) for certain matters.
