He can't but he can appoint someone who the Senate has already sworn in to a high level Position

Acting. The STRENGTHENED GOP Senate will not have a problem approving the President's eventual appointee...SAME AS THE JUDGES HHE WILL BE SEATING....

My understanding is that it must be a Cabinet level position that has already been confirmed by the Senate and there is a time limit before reconfirmation. This swearing in is for an “acting” position......

This is temporary until a full replacement can be confirmed. he has the ability to put in temporary replacements while waiting on a confirmation.

Yup its for an acting position. I'm under the understanding that he can only appoint someone who has passed a high level senate confirmation but I'm not it's as high as a cabinet member. I'm not sure if Whittaker meets the standard or not. The white house seems to think so
