1.) Sex <> Gender and
Gender <> Sex
A Man who is biologically a Man is a Man.
A Woman is biologically a Woman is a Woman.
A Man who is biologically a Man but identifies as a Woman is not a Woman (he is a man that identifies as a woman).
A Woman who is biologically a Woman, but identifies as a Man is not a man (she's a woman that identifies as a man).
Pretty simple and orthogonal and fact based.
"sex and gender are used at times interchangeably based on context but they are not equal"
I agree with you on that point, but there in lies the rub, in that some arguments are in fact using these two distinct terms interchangeably, and really shouldn't.
2.) The NYT's headline of this story is, as you'd expect, misleading, inflaming and hysterical. Typical of NYT's editorial decisions lately.
3.)Seems to me that the definition isn't restricting anyone or anything, just clarifying the definition and the measure used, should there be a question.
4.)or is there another way to read this?
1.) yes i know all those facts and its what I already said thanks for proving me right and accepting facts
2.) actually its not just NYT its another 5 articles i found really easy and even my local news and they all say the same thing and if they are correct the headline is actual quite accurate in regards to topic of legality, legal definitions and protections.
3.) and what you subjectively seem would be factually wrong
4.) yes the factual and reality based way. currently gender is defined as not binary and it has protections under that definition. If this ges down gender will be binary and only that definition will be protected and many people will be screwed and their protections and gender will not exist in a legal sense in this regard.
