Klansman gets 4 years in prison for firing gun at 'Unite the Right' rally

Judge Preston’s feelings obviously were not sufficient grounds to charge or convict this man of anything but shooting a firearm within 1,000 feet of a school. You wouldn’t find a jury anywhere willing to convict this man of any serious charge with video footage of a guy popping out of the bushes trying to set people on fire.

Is it murder if a man is firing a makeshift blowtorch at you so you shoot him? Sounds more like self defense to me and that’s probably why he was charged with shooting a firearm within 1,000 feet of a school instead of a crime like attempted murder or some such thing.

Richard Preston was handed an eight-year sentence Tuesday, with four years suspended. He also will serve three years of supervised probation.

Preston has said he was a the white nationalist rally as a member of a militia -- but he is also Imperial Wizard of a Ku Klux Klan chapter in Maryland. He is shown on the video yelling the n-word and firing a gun in the direction of a black protester who is seen wielding a blowtorch.​

Que the cries of "makeshift blowtorch weapon of mass destruction the black guy was carrying".

A lot of stuff happening in the news suggests cops are confused about our gun laws, and they react and use force inappropriately.

I really think there needs to be an overhaul in police training.

It's getting ridiculous that they arrest people for almost nothing, even beating them or killing people, and call it resisting arrest or disturbing the peace, and then the person often released without charge. Yet you have people pulling guns like this guy, and they do nothing.

Why didn't the cops arrest him or do something?

They are confused and have trouble defining illegal and legal behavior.

Guilty of what? Hmmmm? Why wasn’t he charged with something like attempted murder or assault with a deadly weapon or a charge that actually involves imminent threat to another human being? The answer is because you would never get a conviction from a jury when the defense points out that this is the guy he was shooting at in defense of himself or others:

Well, except he wasn’t convicted of any kind of assault on the other guy. Whether he should have been is a different question but but IMO, you cannot take this conviction for one thing and say it’s indisputable proof that he was actually guilty of something else.

Self defense is an affirmative defense not any kind of a bar to prosecution, though. Charges are filed all the time against people everyone knows is going to claim self defense. It’s up the the judge/jury if they believe the defense or not.

One down, 41 million to go. No, I'm not really advocating for the incarceration of all trump voters for voting the wrong way. But it is fun to think about sometimes.

Ah, I see what you’re saying and you’re right. If the defendant was actually defending himself when he fired the gun, that would be a defense to this charge just the same as any others.

im just saying the only way i could stand corrected is if the law this criminal was found guilty of has no exceptions or is a zero tolerance law and you are not allowed to practice self defense withing the determined school zone. which would be a HORRENDOUS law i would not support
