The Campaign Legal Center flagged that contribution and a $50,000 contribution from another company to a super PAC supporting Florida Gov. Rick Scott’s Senate campaign, in separate complaints to the Federal Election Commission filed Wednesday afternoon.

The donations represent rare violations of a 75-year-old ban on campaign contributions from federal contractors, said Brendan Fischer, director of the federal reform program at the Campaign Legal Center.

“This seems like a brazen violation of well-established law,” he said. “It’s possible that both of these entities are ignorant of the federal contractor ban. But it’s also possible that they expect that they can make large contributions to fed super PACs and get away with it because the FEC has been so reticent to enforce the law.”​
 
Pretty brazen corruption, but, I think Trump figured out nothing he does matters, since the right thinks the left are worse than Satan.

They would have to have accounting that shows where the money is and what specifically that pot of money was spent on. If they can show that the money received was spent in the proper scope the money was requested for, than they are in the clear.

I agree it needs to be looked into, but this by itself doesn't mean guilt it just means it needs to be audited.

HOLY CRAP I know that guy. Randy Perkins is the owner of Ashbritt, well... supposedly it's his wife, but... What a POS. He was also one of the major contributors to both of Obama's inauguration funds, and a bunch of federal level Democrats during the Obama administration as well. He has no party loyalty, although he is a Democrat - his loyalty is to the dollar.

They were one of the big USACE Hurricane Katrina contractors. They were paid ~$500M by FEMA through the Corps for Katrina.

God I hope so. Up until now he's been pretty fire proof. He tried to come after me because I dropped a dime on him once, and he had to pay a fine and lost a contract. He should have gone to jail for that one, but the fine was HUGE which he negotiated to stay out of jail.

What a POS. There are very few people that I can honestly admit that I actually vehemently hate and have to control myself when I see them so I don't act unprofessional and harm my reputation - very, very few. He's one of those few, although not at the top of the list, he's second.

AshBritt founder and chairman Randy Perkins disputed the allegations in the complaint as “absolutely not correct.” He said he paid for the contribution from his personal money but it came from a loan distribution account that he maintains in the company name. “There was a reporting error and that $500,000 was made by me personally, Randy Perkins, not by AshBritt,” he said.
Well, that's either utter BS, ignorance or willful disregard of the law, or maybe a mix thereof. AshBritt is a federal contractor and the only PAC/Super PAC to which it can contribute is one that it establishes. The Super PAC to which AshBritt donated is not its own.


The law itself is quite clear: organizations (and in certain instances, individuals) designated as federal contractors simply cannot contribute to campaigns (441c). A PAC/Super PAC (formally called "SSFs") isn't a campaign; however, Wendy Wagner v. Federal Elections Commission (Wagner) established that the prohibition applied to donations to SSFs.


  • [*=1]Given Wagner, the 441c ban applies to all funds under the dominion and control of the individual government contractor, not just to payments received from the government.

    On the corporate side, a government contractor may create a federal PAC, and its directors, officers, employees and shareholders may make contributions to the PAC and directly to federal candidate campaigns and other political committees; however, if the federal contractor is an individual, 441c proscribes his/her making contributions in connection with federal elections. Consequently, a corporate government contractor, while it may form its own PAC:

  • [*=1]Cannot donate to a PAC that makes only independent expenditures (i.e., a Super PAC). In Wagner, the court noted that there is "substantial doubt" about whether this position is constitutional after Citizens United and SpeechNow.org v. Federal Election Commission; however, the FEC's position is that federal contractor contributions to Super PACs are prohibited.
    [*=1]Must avoid in-kind contributions to Super PACs (and Super PACs must be careful not to accept such contributions). This means, for example, that a federal contractor should not allow use of its office space, employees or other resources (such as a mailing list) by a federal candidate committee, political party or even a Super PAC.
    [*=1]Must still be careful to comply with state and local “pay-to-play” laws. Wagner addresses only contributions made by federal government contractors to federal candidates and PACs, and national political parties. Separately, many states and localities restrict or prohibit political contributions by government contractors and their principals, or require such persons and entities to file public reports disclosing their political contributions.
In light of the prevailing position of the courts and FEC, the contribution was prohibited and unlawful. The violation is, however, civil not criminal.


The central question that needs to be answered and upon which the article is silent is whether the Super PAC returned the donation.
