What is an example of judicial fiat? Marbury? Brown? Miranda? Gore? Heller? Citizens?.....Marshall established the supremacy of the court to determine what is constitutional. By definition, everything they decide is legal, there is no such thing as judicial fiat only the sad cries of those who lost a case before the court.
Under the context of applying how it was originally intended to today, not by making up utterly new definitions, meanings, or powers.
