Emmm... as far as a principle goes, I believe that generally depends on whether or not they were acting in the scope of their employment when they caused the damage, at least in civil law.

Of course congress has a different internal policy.

I'm fine with taxpayers picking up the tab as long as the voters in his district get to take his ass out back and get their money's worth.

I do not have an issue with taxpayer money being used for a case of a govt employee, I do however not approve of him using taxpayer money for settlement payout. If he wanted a settlement he should have paid it out of his own pocket, if he lost the case he should have to pay the bill.
