Should those who have been ruled incompetent be allowed to buy guns?

Hell no.....

I am saying that guns should be bought for whatever reason other than evil.

The US society sucks in so many localities to the point where old folks can't take a stroll at night.
Sadly I agree that there has been a social corrosion taking place that the world a much more dangerous place for everyone.

Depends on the circumstances, but in many cases yes.


When my parents began to have mental issues due to age and illness, we took all the guns out of their house and stored them in our homes (me and my siblings that is). It was a difficult decision and they didn't like it, but we knew they had reached the point where their judgment could not be trusted. Mom, in her last year, was subject to hallucinations.

I've told my own son that if the day comes when I'm clearly no longer in my right mind, it will be his responsibility to disarm me, however unpleasant that may be.

This is how responsible families do it.

that's as stupid as saying the police should be able to raid his house and seize his firearms but guess what, its not a rare position among the bannerrhoid movement members

Yes and it is but, just as with a minor child, it is the responsibility of the legal guardian should things not work out well.

Forgetful isn't the same as homocidal.

They would rather it be legal to slap people onto the terrorist no fly list, without any due process, then pass a law that says those persons can't excercice their 2nd Amendment rights.
 
The reason that the courts must make the call is that being declared a legally incapacitated adult essentially makes one have the legal rights of a minor dependent (cannot vote, buy/own guns, drive or sign contracts) and the court appoints a guardian for that person. Sometimes that guardian is the state, in which case the person is generally institutionalized, but more often a family member is sought to assume that responsibility.

The mental competence and medical diagnoses are determined by the medical profession. The courts decide what should be done with that information.

I suppose that you could look at it that way. The determination that a suspect is likely to be guilty is made by the police and the DA - the courts just decide what to do with that information.

In either case it is not due process until the court decides if that information is credible and to what extent.
