Boasberg said the review was acceptable for the most part, but the Army Corps “did not adequately consider the impacts of an oil spill on fishing rights, hunting rights, or environmental justice, or the degree to which the pipeline’s effects are likely to be highly controversial.”

The tribe isnt even really opposed to it, they seem to just want planning for spills.

The "alternative relief" that Standing Rock Sioux attorney Jan Hasselmen "reluctantly" proposed in court documents filed Monday includes increased public reporting of pipeline issues such as repairs, and implementation of a spill response plan — including equipment staging — at the Lake Oahe reservoir on the Missouri River, from which the tribe draws its water.

Furthermore, he hasnt even shut it down. He only order Army Corp to go back and do more
U.S. District Judge James Boasberg later in June ruled that the Army Corps of Engineers largely complied with environmental law when permitting the pipeline but didn't adequately consider how an oil spill under Lake Oahe might affect the Standing Rock Sioux tribe. He ordered the corps to reconsider certain areas of its environmental analysis and is deciding whether to shut down the 1,200-mile pipeline through the Dakotas, Iowa and Illinois while the work is done.

Hey there my young progress---ive. Peace and Understanding.

Native Americans out there aren't the only ones pissed about eminent domain and water rights, water being the most crucial thing out West, as you know.

Farmers and Ranchers are furious with trump, Zinke, Pruitt, Perry. The pendulum out there is swinging our way.

Just got back a few days ago from the awesome western SD; Badlands Nat'l Park, Black Hills during Sturgis but didn't go to the town; great talks with bikers;?Mount Rushmore and incredible progress---ive Teddy Roosevelt. TR has a Nat'l Park named after him in ND.

Terrible drought in central SD. They bail the ditches on I-90 in eastern SD; 80 mph limits and then some are awesome .

Why would the Native Americans possibly want planning and protection from spills, since every pipeline ever built has spills.

There will be hell to pay downstream on the Missouri River if they ever trash this lifeblood water source, not to mention eventually trashing the Ogallala Aquifer, now 70% depleted .

The farmers here are rightfully concerned about the impact on the soil from the pipeline even though the company claims it wouldn't impact it.
 
I love watching the constitution foil Trump.

Actually, not so much the Constitution. The way I read the OP link is the Judge found fault with the Environmental Impact Statement in that it did not adequately address the pipelines potential impact on fishing and water.

Impact Statements for pipelines can take years to write. I am betting the EIS was done before Trump was elected. Groups challenge EIS all the time. Many times the courts require the EIS to be expanded.

You NE folk are fortunate to have the enormous irrigation systems you have. But how long until the Aquifer is depleted, now estimated at only 30% left?

They can't afford irrigation up in SD, my wife's cousins farm there; they're restricted from the Missouri R., and it's politics that drives who gets the water and how the politicians control the price of H[SUB]2[/SUB]O .
