To what end? To do an end run around the delays by the Senate Democrats? You're right on one thing, if the Senate doesn't gavel out then there can be no recess appointments - the Supreme Court made sure of that when they reversed Obama's actions.

Nobody has to worry about this as Mitch McConell has a history of NOT putting the Senate in recess so the President can make recess appointments. That is what he did with the last President and I am sure his principles and convictions have not changed.

When it comes to slowing down the process, yes there is.

Most Senate business is conducted under "unanimous consent" without the need for debate or votes. All that has to happen is for one Senator to object to unanimous consent, and whatever the motion was on now has to go through an extremely long process to be able to make it back to the Senate floor.

I did, though here you can't always be sure that what should be sarcasm isn't actually deep sincerity.

McConnell will determine that with his own actions should the opportunity come to pass.

We can argue the ethical nature of a recess appointment, but it is a tactic used be many presidents; including the first. However, with control of both houses of congress, there seems little reason to resort to this tactic for Trump.

I was going to ask what at first glance may have been a stupid question -- that is: Is it only the majority leader that can schedule a session of the senate -- in this case, the pro forma's...I just wasn't certain if he alone -- as head of the senate, had that power. It seemed as though he might.

Then I got to wondering, and looked up congressional records, and CRS (Congressional Research Service) reports on pro-formas / recess, etc... till my eyes glazed over a bit -- then stumbled upon this article just out an hour ago, that said the Senate Dems won't let a recess appointment happen. They have "tools" they can use.

"Let me state for the record now, before this scheme gains wings, Democrats will never go along with the recess appointment if that situation arises," Senate Minority Leader Charles Schumer (D-N.Y.) said Tuesday, amid speculation about Sessions’s future in the administration.

He added that Democrats "have some tools in our toolbox" to block Trump from a recess appointment, which would allow the president to bypass what would likely be a contentious confirmation fight.

"We're ready to use every single one of them, any time, day or night. It's so vital to the future of the republic," Schumer said.

Democrats could prevent the Senate from adjourning in mid-August, which could force Republicans to set up "pro-forma" sessions that would effectively block Trump from being able to name a successor without Senate confirmation. "

I think Trump's nonstop Twitter campaign against sessions is to try and get him to quit. So it will look less dramatic if sessions quits and gets replaced with someone who fires Mueller than if he fires sessions to replace him with someone who fires Mueller.

"I didn't fire sessions he quit on his own. Therefore I didn't do anything to fire Mueller. I just had to replace my AG and he made that decision on his own."

That's what I think is coming should he get his way.
