In order to be legally provoked, there would need to be a threat from which one needed to defend oneself. There is no way the reporter could be construed as a threat. An annoyance? Sure. Provocative? Sure. A threat? No way.
I would agree that from everything we've seen this is the case, and indeed he has been charged. I find it disturbing that there were partisans even trying to play this off or laughing at the assault of the Press at the hands of a politician. And assuredly, had the R been a D, those laughing would be outraged instead.
The investigation continues, but he needs to be properly punished for this crime. Politicians cannot be allowed to start getting away with assault against the Press.
