An Idaho judge has ordered a 19-year-old man not to have sex with anyone before he marries as part of his sentencing for statutory rape of a 14-year-old girl.

Judge Randy Stoker sentenced Cody Duane Scott Herrera of Twin Falls to five to 15 years in prison, but he suspended the sentence for a one-year rider program. If the unmarried Herrera completes the program, he'll be released on probation, which requires celibacy unless he weds. Herrera received the sentence in 5th District Court.

The big issue here, according to judges and lawyers, is whether or not forced celibacy violates the convicted man's Constitutional rights. But that is not the way I see it. The issue should be that a judge gave a rapist and child molester freedom, when that punk should be serving time. That judge is not qualified to sit on the bench. Period.

Seriously, I fervently hope the man appeals his sentence and wins, because that means the original sentence of 5-15 years in prison would be restored, and then he can have plenty of sex.... From Bubba the Butt Bandit.

I know this is going to be an unpopular opinion but I'm not sure how I feel about calling someone with a five year age gap, and who is also a teenager, a child molester for having consensual sex with another, younger, teenager.

Read the article. He bragged during his probation interview about dozens of girls he was able to convince to have sex with him. He might be 19, but he is a sexual predator. And 14 years old is not consensual, according to the law. This asshole is a rapist and molester, and should serve time as a rapist and molester.

How about we not use rape and stationary rape interchangeably. Rape depends on lack of consent, while stationary rape depends on the age of the "victim".

Anyway, this ruling exposes a serious problem towards the rights of men in this country. If the government did this to a woman they would never get away with it without protests from feminists, but doing the same to a man gets approval from men. Sigh.

Jesus. You realize that consent is not dependent on some law, right? The law can't change the fact that someone actually CONSENTED to an act being done to them, but only determine that their consent is not important to the law. In short, consent comes from the individual, not from law.

Unless we are talking about a baby or something you should refrain from suggesting that the capability of consent is not possible. There is a difference between they can't understand something and they can't consent. Of course, the law fudges this and uses the two like they are same thing.

Ted Nugent is sixty-eight, not forty. Anyway, nothing you said affects things at all. There is a difference between lack of understanding and lack of consent. The idea that it is not possible to consent to things you don't understand is based on a false understanding of how consent works.

Henrin, I understand your thought process here. But I think it we change the parameters a bit, it will be clearer to you what age of consent means and how important it is in the eyes of the law.

Imagine the girl is NOT 14. Imagine she is five years old.

IMO, although the law in this state considers 14 below the age of consent, I personally don't think it should be bright red. So one could argue the age but not the principle... in my opinion.

The constant revisionism of those suggesting Trump did not mean it when he bragged about sexually assaulting women is indeed disgusting! And loathsome. One might even say deplorable.

I wasn't justifying or not justifying anything. What I was doing was correcting a misconception about how consent works and why understanding a situation and consenting to a situation are not the same thing.
